ENVIRONMENTAL AWARENESS IN TERMS OF İSLÂMIC LAW

Abstract

While it is not possible to mention about systematic environmental law in the classical sources of İslâmic Law today, there are general principles in the Qur'an and circumcision which will form the ground for environmental law. There are many verses in the Qur'an that provide environmental protection awareness. In the Sunnah of the Hz. Prophet, there are many hadiths that both he did and said. The principles and rudiments in the Qur'an and in the Sunnah give an important responsibility to the Muslims about environmental awareness. In this respect, it is crucially important to ensure the sustainability ofenvironmental resources and to protect the environment (that is created to meet the needs of the people) with all its resources. When there are no international regulations on the environment or even agenda, İslâmic scholars' declaration of universal opinion on environmental protection is worthwhile as an advanced stage of fiqh heritage.

İslâm Hukukunun klasik kaynaklarında günümüz şekliyle sistematik birçevre hukukundan söz etmek mümkün olmamakla beraber çevre hukukuna zeminteşkil edecek Kur’an ve sünnette genel ilkeler mevcuttur. İslâm hukukunun temelkaynağı Kur’an-ı Kerim’de çevre koruma bilincini sağlayan birçok âyet vardır. Hz.Peygamber’in Sünnetinde de hem fiili hem de kavli birçok hadis yer almaktadır.Kur’an ve Sünnette yer alan ilke ve esaslar, Müslümanlara çevre bilinci hususundaönemli bir sorumluluk yüklemektedir. Bu bakımdan çevre kaynaklarınınsürdürülebilirliğinin sağlanması, insanların ihtiyaçlarını temin gayesiyle yaratılançevrenin bütün ögeleriyle korunması da hayati derecede önem arz etmektedir.Çevre ile ilgili uluslararası düzenlemelerin olmadığı hatta gündem bile yapılmadığıdönemlerde İslam âlimlerinin çevre korumaya dair evrensel nitelikli görüş beyanetmeleri fıkıh mirası açısından ileri bir aşama olarak kayda değerdir.
