Personal fault in the light of supreme court decisions

Abstract
Historical development of personal fault understanding, its features, criteria, the conditions of personal fault, its relationship with service-connected fault and voie de fait and the relevant legal regulations are reviewed in light of Supreme Court decisions. In this context, legal problems that occur both at the constitutional-legal level and in practice resulted from personal fault understanding are identifi ed and developed recommendations for solution of such problems.
Özet
Kişisel kusur anlayışının tarihsel gelişimi, özellikleri, ölçütleri, kişisel kusur sayılan haller, hizmet kusuru ve fiili yol ile ilişkisi ve konu ile ilgili hukuksal düzenlemeler Yargıtay kararları ışığında incelenmektedir. Bu çerçevede kişisel kusur anlayışının hem Anayasal ve yasal düzeyde hem de uygulamada ortaya çıkardığı hukuksal sorunlar tespit edilmekte ve bu sorunların çözümüne yönelik öneriler geliştirilmektedir.
