THE RELATIONSHIPS OF THE HEIRS WHO LOSE THEIR INHERITANCE RIGHTS WITH THE COMMUNITY OF HEIRS

Abstract

The principle of joint action and the principle of heirs joint and several liability with their entire properties for the debts of testator within the community of heirs primarily require the identifi cation of the people who take place within the community of heirs. Especially determining whether the heirs who lose their inheritance rights are liable for the debts of testator and to what extent this liability exists are of great importance. This study aims to analyze the effects of disinheritance, unworthiness to inherit, renunciation of inheritance, and disclaimer of inheritance, which are also known as the grounds for the loss of inheritance rights, to the community of heirs.

Özet

Miras ortaklığında geçerli olan elbirliği ile hareket ilkesi ve mirasçıların mirasbırakanın borçlarından müteselsil ve şahsi olarak sorumlu olmaları, miras ortaklığında yer alacak kişilerin öncelikle tespit edilmesini gerektirmektedir. Özellikle mirasçılık sıfatını kaybeden kimselerin mirasbırakanın borçlarından sorumlu olup olmayacaklarının, sorumlu olacaklar ise de bunun ne ölçüde olacağının belirlenmesi önem arz etmektedir. Bu çalışmada mirasçılık sıfatının yitirildiği hâller olarak kabul edilen mirasçılıktan çıkarma, mirastan yoksunluk, mirastan feragat ve mirası ret durumlarının miras ortaklığına etkisi incelenmiştir.
