Abstract

Globalization is one ofthe important concept nowadays affecting our world. With globalization, we have witnessed serious changes in political, economical social and cultural structures in the world. Main factor which impacts this change is the stunning developments in the information and communication technologies. One of the impressive examples in the information and communication technologies is Internet, and Internet is deemed as one of the important inventions of 20’” century. Thanks to the invention ofInternet, the information shared and the com— munication at local and international level have been reached to an unimaginable extent and as consequence of which the world virtually became smaller in that sense. Today, it is possible to access to the information in cheap and rapid manner. Protection of private life is one of the essential rights and liberties that man— kind owns. Protection of private life emerges as an important concept throughout the history, up until now. Interfering with the private life is growing with the fact that internet becomes part ofour daily life. The Law No. 5651 on “Regulating Broadcasting in the Internet and Fighting against Crimes Committed through Internet Broadcasting” was adopted to combat with the crimes committed at internet environment. Afterwards, Article 9/A was incorporated to the said Law. With the incorporation ofArticle 9/A, now it is possible to block the access to the web page which includes content that interferes with the private life ofpeople. In this study, within theframe ofArticle 9/A ofthe Law No: 5651, it is aimed to find solutions to the problem of contents broadcasted at internet platform which interferes with the private life.

Bugün, İnternet kullanarak pek çok b lg ye kolay, ucuz ve hızlı b r şek lde er şmek mümkündür. Özel hayat, insanın sahip olduğu en önemli temel hak ve özgürlüklerden birisidir. İlk çağdan günümüze ve tarihin her döneminde özel hayat önemli bir kavram olarak karşımıza çıkmaktadır. İnternetin günlük hayatımızın bir parçası haline gelmesiyle, özel hayat ihlalleri gittikçe artmaya başlamıştır. Ülkemizde İnternet ortamında işlenen bazı suçlarla mücadele amacıyla, 5651 sayılı "İnternet Ortamında Yapılan Yayınların Düzenlenmesi ve Bu Yayınlar Yoluyla İşlenen Suçlarla Mücadele Edilmesi Hakkında Kanun" hazırlanmıştır. Söz konusu Kanun'a 2014 yılında 9/A maddesi eklenmiştir. Bu madde ile İnternet ortamında yer alan ve özel hayatı ihlal eden bir içerik nedeniyle söz konusu İnternet sitesine erişim engelleme imkânı getirilmiştir. Bu çalışmada, 5651 sayılı Kanun'un 9/A maddesi çerçevesinde, İnternet ortamında yer alan ve özel hayatı ihlal eden içeriklere karşı neler yapılabileceği sorusuna cevap bulunmaya çalışılmıştır
