Abstract

Adultery, which has been described as an ugly, haram, sin and immoral act inthe eyes of societies, has been punished in various ways throughout the history. Penalties foradultery crimes vary according to the law of societies and morality of societies. Some societieshave only condemned these adulterous, while others have punished them with the greatestpunishment that can be given. In the Ottoman Empire, the crime of adultery, which is describedas an action against the public morality, has been punished in accordance with the provisionsof şer’i and örfi laws. With the new criminal law in the 19th century, the penalties imposedon adultery were relatively changed. However, the implementation of religious provisions wascontinued due to the fact that şer’i courts continued their duties. In addition, “the woman whocommitted adultery and evil must have been killed related” this fetva applyed. to the relativeswho saw the woman and his accomplice in adultery and killed him, şer’i law and code don’tpunishment. Therefore, today’s murders, called honor killings, have become happened in theOttoman Empire, which dominated a wide geography.
