SOME TURKISH LAW ISSUES REGARDING THE GOVERNING LAW FOR THE INSURANCE CONTRACTS INCLUDING ELEMENT OF FOREIGNNESS

Abstract
In case an insurance contract includes an element of foreignness, thenumber of issues regarding the conflict of laws may arise. In Turkish international private law, rules of conflict of laws arranged for the determination of the governing lawapplicable to the private law relations that include an element of foreignness are regulated under the International Private and Civil Procedure Law (IPCPL) numbered 5718.Since the IPCPL does not set forth a special rule of conflict of laws for the determination of the law to be applied to the insurance contracts including an element of foreignness, the governing law for these contracts shall be determined by the general rules ofconflict of laws regulated under Article 24 of the IPCPL. On the other hand, if the insurance business is deemed as a part of the social and economic policies of the state,there are cases in which the governing law determined by the rules of conflict of laws isremoved and directly applied rules are applied. Likewise, the provisions setting forthminimum protection for the weak party in the insurance contracts with the nature ofconsumer transactions can be directly applied to the dispute.
Özet
Sigorta sözleĢmesinin yabancılık unsuru taĢıması halinde birtakım kanunlar ihtilafı problemi ortaya çıkar. Türk milletlerarası özel hukukunda yabancılık unsuru içeren özel hukuk iliĢkilerinin tabi olacağı hukuki rejimi tayin etmek için geliĢtirilen kanunlar ihtilafı kuralları 5718 sayılı Milletlerarası Özel Hukuk ve Usul Hukuku Hakkında Kanun‟da (MÖHUK) düzenlenmiĢtir. MÖHUK, yabancılık unsuru içeren sigorta sözleĢmelerine uygulanacak hukukun tayininde özel bir kanunlar ihtilafı kuralı öngörmüĢ olmadığı için bu sözleĢmelerin tabi olacağı hukuk, MÖHUK madde 24‟teki genel kanunlar ihtilafı kuralına göre belirlenecektir. Öte yandan sigortacılık faaliyeti, devletin sosyal ve ekonomik politikalarının bir parçası olarak kabul edildiği takdirde, kanunlar ihtilafı kurallarının gösterdiği hukuk bertaraf edilip, doğrudan uygulanan kuralların devreye girdiği haller de mevcuttur. Keza tüketici iĢlemi niteliğindeki sigorta sözleĢmelerinde zayıf tarafa asgari koruma öngören kanun hükümleri de doğrudan uyuĢmazlığa uygulanabilecektir.
