Monitoring of employees in the work places by the employer and the protection of personal rights of the employee

Abstract
The employer has the right to examine the websites on the Internet which are visited in the course of their work day by the employees working in accordance of the employment contract and the other electronic communication activities for the sake of the economical future of the work place and employer. In fact, the employer is obliged to respect the employee’s privacy and communication freedom. To control employees’ private communications and monitor their activities in the work place is against the law. However, the economic future of the employer and the measures which have to be taken against the possible thefts in the work place make the monitoring legal. The employee can only use the competences stated in the article 25 of the Civil Code and article 49 of Law of Obligations against the employer in case of absence of the legal circumstances.
Özet
İşveren, işyerinde iş akdi doğrultusunda çalıştırdığı, işçilerinin iş za-manlarında gerçekleştirdikleri İnternette ziyaret edilen siteleri ve diğer elektronik haberleşme faaliyetlerini, işyerinin ve işverenin ekonomik gelece-ği açısından inceleme yetkisine üstün yarar açısından sahiptir. Gerçekte işveren işçisinin özel hayatına, haberleşme hürriyetine saygı göstermekle yükümlüdür. İşverenin işçilerinin özel haberleşmelerini denetlemesi, onları işyerinde izlemesi hukuka aykırıdır. Ancak, yukarıda anılan işverenin, eko-nomik geleceği, işyerinde yaşanması muhtemel hırsızlık olaylarına karşı alınması gereken tedbirler, söz konusu izlemeyi hukuka uygun hale getirmek-tedir. İşçi ancak, hukuka uygunluk halinin olmadığı durumlarda, TMK. m. 25 ve BK. m. 49 (TBK. 58/I)’da anılan yetkileri işçi işverenine karşı kullana-bilir.
