Comparision of Turkish constitutions to those of some democratic countries with regard to freedoms of religion and belief

Abstract
Constitutional guarantee for freedom of religion and belief is quite im- portant for psychological health and social peace of individual and society. Contemporary democratic societies consider freedom of religion and belief among basic rights and freedoms like freedom of conscience, freedom of expression, freedom of thought etc. This paper compares constitutions of Turkish Republic with regard to freedom of religion and belief to those of the countries which give a consid- erable place for democratic rights and freedoms in their legal and political systems. It has been found out that constitutions of Turkish Republic re- markably lack the pluralist, libertarian, individual and civil society oriented, unbiased, egalitarian and impartial democratic legal standards with regard to attitude of the state towards both religions and faiths and religious and ideo- logical groups.
Özet
Din ve inanç hürriyetinin anayasal düzeyde teminat altına alınması, fert ve toplum hayatının ruhi selameti ve sosyal barışı açısından fevkalade ehemmiyetlidir. Çağdaş demokratik toplumlar, din ve inanç hürriyetini vic- dan, ifade ve düşünce hürriyeti gibi temel hürriyetler çerçevesinde değerlen- dirmektedir. Bu çalışmada Türkiye Cumhuriyeti Anayasaları ile demokratik hak ve hürriyetlere siyasi ve hukuki sistemlerinde önemli yer veren bazı ülkelerin anayasaları din ve inanç hürriyetleri bakımından karşılaştırılmıştır. Yapılan tespitlerde Türkiye Cumhuriyeti Anayasalarının devletin gerek din ve inanç- lar ve gerekse farklı inanç grupları karşısındaki tavrı bakımından, demokra- tik sistemlerin gerektirdiği çoğulcu, hürriyetçi, fert ve sivil toplum merkezli, önyargısız, eşitlikçi ve tarafsız bir hukuki altyapıdan uzak olduğu sonucu ortaya çıkmıştır.
