Constitutional court decision in terms of administrative and legal structure of Turkish football federation and suggestions related to the structure of arbitration commission in the light of the constitution amendment

Abstract
Sports organizations, especially football are major economic activities that are widely acclaimed. The decisions given by the sports federations are generally undetermined in the judicial process and this situation does not comply with this dynamic structure. The Arbitration Commission decisions were included to the scope of judicial review by the Constitutional Court. However, the Constitution has been quickly amended by the Parliament due to dynamic structure of football. Therefore, the decisions of the Arbitration Commission are again excluded from judicial review. Current structure reveals various concerns in public opinion. In this study, we aim to bring forward some suggestions that will enable objectiveness of the decisions.
Özet
Spor organizasyonları özellikle futbol bugün çok geniş kitlelere hitap eden büyük ekonomik etkinliklerdir. Federasyonlarca verilen kararların yargı sürecinde uzun süre belirsiz kalması, bu dinamik yapıyla bağdaşmamaktadır. Anayasa Mahkemesi, Tahkim Kurulu kararlarını yargı denetimine açmıştır. Sporun dinamik yapısı nedeniyle yasama organı tarafından Anayasa çok hızlı şekilde değiştirilmiştir. Tahkim Kurulu kararlan yeniden yargı denetimi dışında bırakılmıştır. Ancak mevcut yapı, kamuoyunda birtakım kaygıları gidermekten uzak olduğundan bu çalışmada kararların tarafsızlığını sağlayıcı bazı öneriler getirilmiştir.
