The social contact term in German Law

Abstract

In the cases that the essential components of tort liability are not occurred, necessities of the modern social systems require a party to make performance or to accept the performance by third parties without having to choose the other party of a contract or without having to specifically determine the content of a contract. Such cases may occur in labour law besides in the other areas of law. Where there is no contractual relationship due to absence of a valid offer and acceptance and the conditions of tort liability are not fulfilled, the source of equitable duty to perform in German doctrine is explained via the term of social contact provided that the other requirements are met. In this study, the term of social contact in German Law, which was originally asserted by Günther Haupt in early1940s and had the effect of an atom bomb in German doctrine will be examined in order to provide a perspective to Turkish law.

Özet

Modern sosyal sistemlerin gerekleri, haksız fiilin sartlarının olusmadığı bazı durumlarda bireyleri diğer sözlesme tarafını seçmeden veya diğer sözlesme tarafıyla sözlesmenin içeriğini özel olarak belirleyemeden, edimleri ifaya ya da üçüncü kisilerce yapılan ifaları kabule yönlendirmektedir. Bu tür durumlar hukukun diğer alanlarının yanında is hukuku alanında da söz konusu olabilmektedir. Klasik anlamda icap ve kabulün mevcut olmaması nedeniyle sözlesme iliskinin varlığından söz edilememesinin yanında, haksız fiilden kaynaklanan sorumluluk sartlarının gerçeklesmediği durumlarda hak ve nesafet kuralları gereğince doğduğu kabul edilen ifa ödevinin kaynağı Alman doktrininde, -diğer sartların da varlığı halinde- sosyal temas kavramı kullanılmak suretiyle açıklanmaya çalısılmıstır. Bu çalısmada Türk hukukuna ısık tutması açısından 1940lı yılların baslarında Günther Haupt tarafından ilk defa ortaya atılan ve Alman doktrininde atom bombası etkisi gösterdiği ifade edilen sosyal temas kavramı Alman hukuku çerçevesinde tanımlanmaya çalısılacaktır.
