Being in Insolvency and Suspension of Insolvency Issues in Building Cooperatives

Abstract
Building cooperatives are the most common sort of cooperatives. According to TTK m. 124, housing cooperatives are considered as commercial companies too. According to 63rd article of Cooperatives Law and İİK m. 179, if housing cooperatives fall in insolvency, they can recourse suspension of insolvency. Recoursing the suspension of insolvency has some condicio juris and these are required for housing cooperatives too. The condition of being in insolvency which is the most important condition, has some differences and issues compared to the other corporations because of its sui generis specifications.
Özet
Kooperatifler içinde en çok kurulan tür konut yapı kooperatifleridir. Konut yapı kooperatifleri de TTK m.124e göre bir ticaret şirketi olarak kabul edilmektedirler. Konut yapı kooperatifleri faaliyetleri sırasında aciz haline düşerlerse Kooperatifler Kanunu m.63 ve İİK m.179 uyarınca iflas ertelemeye başvurabilirler. İflas ertelemeye başvurabilmenin bazı şekli ve maddi şartları söz konusu olup, bu şartlar konut yapı kooperatifleri için de aranır. İşte bunlardan en önemlisi olan borca batık olma şartı konut yapı kooperatiflerinde, kooperatifin kendine özgü özellikleri nedeniyle diğer sermaye şirketlerine nazaran farklı- lıklar ve sorunlar taşımaktadır.
