From Negotiator Democracy Model to Communicational Democracy Ideal: Reading the Film “Judgment at Nuremberg” on the Rhetoric Axis

Abstract

According to the deliberative democracy model, only arguments are evaluated during the speech, and elements such as identity, gender, appearance, speaking style, gestures, and facial expressions are not taken into account when discussing the argument. However, these elements, which cannot be ignored by the audience, affect the feelings of sincerity, belief, and persuasion towards the speaker. Based on this, Young introduced the “communicative democracy model” beyond deliberative democracy, including these elements. One of the most important concepts in this model is rhetoric. In this study, court spaces, which are a public sphere, and the elements of judicial rhetoric used here are examined. In the study, in which the 1961 film “Judgment at Nuremberg” is taken as a sample, the “communicative democracy model” developed by Young and the judicial rhetoric elements classified by Cicero as the “Five Canons of Rhetoric” are reconciled. In the film, which is analyzed with the critical-rhetorical film analysis method, the rhetorical elements in the speeches of the allegation and defense authorities are analyzed based on the trial scenes. It turned out that elements of judicial rhetoric are used explicitly or implicitly even in scenes of deliberative democracy in the film.

Müzakereci demokrasi modeline göre, konuşma esnasında sadece savlar değerlendirilmekte ve sav tartışılırken kimlik, cinsiyet, görünüş, konuşma üslubu, jest ve mimikler gibi ögeler dikkate alınmamaktadır. Oysa dinleyiciler için göz ardı edilemez olan bu ögeler, konuşmacıya karşı duyulan samimiyet, inanç, ikna duygularını etkiler. Bundan hareketle Young, müzakereci demokrasinin ötesinde, bu ögelerin de dâhil olduğu “iletişimsel demokrasi modeli”ni ortaya koymuştur. Bu model içerisinde yer alan en önemli kavramlardan biri ise retoriktir. Bu çalışmada, doğası gereği savların ön planda olması beklenen bir kamusal alan olan mahkeme mekânları ve burada kullanılan adlî retorik ögeleri incelenmektedir. 1961 yapımı Nuremberg Mahkemesi filminin örneklem olarak ele alındığı çalışmada, Young’ın yeni bir bakış açısı olarak geliştirdiği “iletişimsel demokrasi modeli” ile Cicero’nun “Retoriğin Beş Kanonu” olarak bölümlendirdiği adlî retorik ögeleri bağdaştırılmaktadır. Eleştirel-retoriksel film analizi yöntemiyle incelenen filmde, duruşma sahneleri esas alınarak, iddia ve savunma makamlarının konuşmalarındaki retorik ögeleri analiz edilmektedir. Filmin, savların ön planda olduğu ve en akılcı kanıtların sunulduğu müzakereci demokrasi görünümü kazanan sahnelerinde dahi, açık veya örtük şekilde adlî retorik ögelerinin kullanıldığı ortaya konulmuştur.
