Abstract

The usage and customs have an important position in the pratic of Islamic law. The Hanafi school of thought, which is serious cult of Islamic law is one of them who are putting an emphasis to the usage and customs. El- esbah ve'n-Nezair named work of Ibn Nuceym is approved as most systemically study about the bases of the Hanafi school of thought. He explains "el adetu muhakkematun" one of the fi rst 6 bases about the usage. In this work, we have analysed the topic about the usage from Ibn Nuceym' s work Kavâid, who has analysed the usage theoretically and explained with samples for the fi rst

Özet

Örf ve âdet, İslâm hukuku pratiğinde önemli bir yere sahiptir.İslâm hukukunun önemli ekollerinden olan Hanefî mezhebide örfe en çok önem veren fıkıh mezheplerinden birisidir. İbnNüceym'in el-Eşbah ve'n-Nezâir adlı eseri de Hanefî mezhebindefıkıh kaidelerine dair en sistematik ilk çalışma olarakkabul edilir. Bu eserde müellif ilk altı küllî kaideden örfedair "el-Âdetü muhakkemetün" kaidesini açıklamıştır. Bizde bu çalışmamızda Hanefî mezhebinde ilk defa, örfü teorikbir şekilde inceleyen ve örneklerle açıklayan İbn Nüceym'inkavâide dair bu eserindeki örfl e ilgili kısmı inceledik.Anahtar Kelimeler: İbn Nüceym, el-Eşbah ve'n-Nezâir,İslâm Hukuku, Örf, Âdet.
