An alternative mechanism to patents in pharmaceutical markets

Abstract

This paper presents an alternative to the pharmaceutical patents that cause high prices and social welfare loss in the short run in order to motivate innovation in the pharmaceutical drug market in the long run. According to my proposal, the innovator firm would sell the patent rights to the relevant public agency. By not exercising its patent rights, the agency would allow new drugs to be sold for a lesser price in the market. The price to be paid to the innovator firm in exchange for its patent, will be calculated by multiplying the actual sales of the drug with a coefficient which depends on the relative morbidity costs of the diseases that the drug addresses.

Bu makalede uzun vadede inovasyonu teşvik ederken kısa vadede fiyatları yüksek tutarak sosyal refah kaybına yolaçan patent sistemine ilaç sektörü bağlamında bir alternatif sistem önerisi getirilmektedir. Teklife göre ARGE faaliyetleri sonucunda yeni bir ilaç bulan firmanın patent haklarını devlet satın alacak ve patent haklarını kullanmayarak ilacın piyasada patentsiz bir şekilde satılmasına izin verecektir. Kamu kurumu patenti satın alırken ödeyeceği miktarı ise ilacın sene içindeki satış miktarı ile ilacın tedavi ettiği hastalığın topluma maliyetine bağlı olarak değişen bir katsayıyla çarparak belirleyecektir.
