AN UNSOLVED DILEMMA: THE CRIME OF HAVING CONSENSUAL SEXUAL RELATIONS WITH A MINOR

Abstract
This paper discusses the crime of having consensual sexual relations with a minor set out in section 104 of the Turkish Penal Code 5237. Since this section came into force in 2005, it has been a topic of heated debates for many reasons due to an ambiguous terminology and language used in the section. For instance, a definition of “sexual” relations or activities is not set out in the section, and it is uncertain whether the crime has been committed in cases where there is a mutually agreed sexual activity between children who are over 15 but not reached the age of 18 which is the age of legal maturity. Such ambiguities also caused hesitation over the primary intention of lawmakers concerning whether they recognize sexual autonomy of those children who are over 15 but not reached the age of legal maturity. So, this article discusses the crime of having consensual sexual relations with a minor and argues that the issue of havingconsensual sexual relations with a minor will remain an unsolved dilemma. Özet
Bu makalede, 5237 sayılı Türk Ceza Kanunu’nun 104’üncü maddesinde düzenlenen “reşit olmayanla cinsel ilişki” suçu, bu düzenlemenin Türk hukuksitemine girdiği andan günümüze kadar geçirdiği aşamalar ve uygulamada yaşanan sorunlar dikkate alınarak tartışılacaktır. Suçun hukuki konusuna, faile, mağdura, suça konu teşkil eden “cinsel ilişki” deyimine ve şikâyet hakkına ilişkin ayrıntılı tartışmalara değinilecek, öğretide yer alan görüşlere yer verilecektir. Karşılaştırmalı hukuktan örnekler verilerek, suçun düzenleme biçiminden kaynaklanan sorunların çözümüne ilişkin öneri ve yorumlarda bulunulacaktır.
