Abstract

Together with the development of science and technology, we are going through a period in which communication and interaction between communities are spreading rapidly. With the rapid progress in the communication sector, social media has entered almost every household. Borders between countries removed, the world turned into a small village. There is no limit to interpersonal communication. The rapid develop- ment in technology has brought people together to meet many cultures and beliefs and face together. The contamination of the information pollution caused by the Internet culture has been confronted with a lot of confusion. This confusion led to the collapse of the belief system. Person has found himself in the venomous clamps of many per- verse currents. The effect of the words of their mouths on the world of faith has been ignored. Fluctuations in spiritual life has a devastating impact on the world of morality and action. Family law is the system most affected by this shock. Increase in words and actions that will shake the belief system through social media. The issue of apostasies effect of the marriage contract should be analyzed. In this respect, we think it is a current issue. In this study, the dangers and behaviors of the deflector currents through the internet In Islamic Law we have explained in connection with the elfâz-ı küfr. As a result today, the discourses that will lead to itikadi problems have been extremely proliferated. If one of his spouses does not take the violent form of his family and his / her environment marriage should not be finished.

Özet

Bilim ve teknolojinin gelişimi ile birlikte toplumlar arası iletişim ve etkileşimin hızla yayıldığı bir dönemden geçiyoruz. İletişim sektöründeki hızlı ilerleme ile sosyal med- yanın hemen hemen her haneye girmesi kişiler ve ülkeler arası sınırları kaldırarak dün- yayı âdeta küçük bir köye dönüştürmüştür. Teknolojide yaşanan hızlı gelişim, insanları pek çok kültür ve inançla buluşma ve bir arada yaşama durumuyla karşı karşıya getir- miştir. İnternet kültürünün yol açtığı bilgi kirliliğinin girdabına düşen insan, pek çok kafa karışıklığı ile karşı karşıya kalmıştır. Bu kafa karışıklığı, kişinin inanç sisteminde çöküntülere yol açmış, kendisini birçok sapık akımın zehirli kıskaçlarında bulmuştur. Ağızlardan çıkan sözlerin, yapılan eylemlerin inanç dünyasına etkisi önemsenmez ol- muştur. Manevi hayatın temelini oluşturan inanç sisteminde yaşanan çalkantılar, bu temel üzere kurulan ahlak ve amel dünyasında da yıkıcı etki yaratmıştır. Aile hukuku da bu sarsıntıdan en çok etkilenen sistemdir. Sosyal medya aracılığıyla inanç sistemini sar- sacak kelime ve eylemlerin bu denli artış göstermesi bunların evlilik akdinde meydana getireceği etkinin analiz edilmesini gerektirmektedir. Bu açıdan konunun güncelliğini koruduğunu düşünmekteyiz. Biz bu çalışmamızda saptırıcı akımların internet aracılı- ğıyla yaydığı inkârcı söz ve davranışların klasik fıkıhta yer alan elfaz-ı küfür kavramı ile bağlantılarını tespit ederek evlilik akdine etkisini değerlendirmeye çalıştık. Sonuç itibarıyla; elfaz-ı küfrün sebep olduğu itikadi problemlerin fıkhi değerlendirilmesinde; itikadi problemlere yol açacak inkârcı söz ve davranışların irtidad kapsamında değer- lendirileceği, bu durumun ise nasslarda evliliğin kurulmasına ve devamına engel olarak görüldüğü kanaatine ulaşılmıştır.
