Abstract

The groups of people who produce the production are called employees. Employees can work dependent on others as well as they can work without being dependent. De- pendent workers are those who contribute to production with only their labor and who work depending on employers. Independent employees are those who work on their behalf without being dependent on others. This article is extracted from my doctorate dissertation entitled “The Relationship of Employment and Responsibility of the Employers in Islamic Law”(PhD Dissertation, Ankara University, Ankara/Turkey, 2007).as private workers and common workers. The employer is the person who works on the other side of the employment contract according to the worker or the person who works someone else by the wage. In Islamic law, employees have the rights to work in an appropriate job and in appropriate conditions and to permit and rest and to pay their religious needs and to receive wages in return for their labor. Islam recognized to the person, the right and the liberty to work in a business suitable for his power and abil- ity, regardless of he is at which social segment. The work subject to the contract must be within the employee’s power and control. Rest is the removal of physical fatigue. Resting is a compulsory obligation to restore person’s working power and the right of the worker to rest is a result of the principle of protecting the worker who dominates the labor law. If the employer does not allow the employee to pray, there are different opinions on how the employee will perform their prayers.

Özet

Üretimi meydana getiren insan gruplarına çalışanlar denilmektedir. Çalışanlar, başka- larına bağımlı olarak çalışabildikleri gibi bağımsız olarak da çalışabilirler. Bağımlı çalı- şanlar, üretime genellikle sadece emeği ile katkıda bulunan ve işverenlere bağlı olarak çalışan kişilerdir. Bağımsız çalışanlar ise başkasına bağımlı olmadan kendi adına çalışan kişilerdir. Hem iş akdinin tarafı hem de akit konusu işi yapacak kişi olması itibarıyla iş akdinin en önemli unsuru olan çalışan, İslam hukukuna göre ecîr-i hass ve ecîr-i müşterek olarak iki kısma ayrılmaktadır. İşveren ise iş akdinin işçiye göre diğer tarafı veya ücretle başkasını çalıştıran kişidir. İslam hukukunda çalışanların uygun bir işte ve uygun koşullarda çalışma, izin ve dinlenme, dinî ihtiyaçlarını karşılama ve verdiği emeğin karşılığında ücret almak gibi hakları bulunmaktadır. İslam, hangi sosyal kesim- de olduğuna bakmaksızın kişiye güç ve kabiliyetine uygun bir işte çalışma hürriyeti ve hakkı tanımıştır. Akit konusu işin, ifasının mümkün ve çalışanın gücü ve kontrolü dâhilinde bulunması gerekmektedir. Dinlenme, bedensel yorgunluğun giderilmesidir. Dinlenme, insanın çalışma gücünün yeniden kazanılması için fıtri bir mecburiyet olup çalışanın dinlenme hakkı, iş hukukuna hâkim olan işçiyi koruma ilkesinin bir sonu- cudur. İşverenin çalışanına namaz kılmak için izin vermemesi durumunda çalışanın, namazlarını ne şekilde ve nasıl kılacağı hususunda farklı görüşler mevcuttur.
