FELSEFENİN FIKHÎ HÜKMÜFUKAHA’NIN FELSEFEYE BAKIŞI ÜZERİNE ELEŞTİREL BİR DEĞERLENDİRME

Abstract

This study aims to make an assessment of the negative views on the juridical ruling of philosophy in the literature of Islamic Law. Because the attempt to find a positive opinion about the answer to philosophical activity in collected works of Fiqh looks like looking for a needle in a haystack. For this reason, firstly it is very important to find out to determine what are the negative approaches to philosophy in fiqh literature and for what reasons have been reached these conclusions.The subject of our study is the negative approaches of Islamic jurisprudence about the religious verdict of philosophical activity. We will get the opinions on this subject from the titled "Is it Lawful that Philosophy Discusses ‘Truth’?"article that the product of comprehensive research and has been prepared by Ahmet Selman Baktı.As it is known, there are many verses in the Quran that recommend using the mind. The criticism of fuqaha about philosophy whose basic principle is shaped to use mind contradicts this fact. It is known that fiqh as a science is based on jurisprudence, and the analogy that requires the use of reason has a large share in it. In this case, the fiqh criticizes philosophy since it uses its method, and this is a tautology.

Özet

Bu çalışma, İslam Fıkıh literatüründe felsefenin fikhî hükmü konusunda serdedilmiş olumsuz görüşlerin bir değerlendirmesini yapmayı amaçlamaktadır. Zira Fıkıh müdevvenatında felsefi faaliyetin cevazına dair olumlu bir görüş bulma çabası, samanlıkta iğne aramak kabilinden bir durum gibi gözükmektedir. Bu nedenle, öncelikle fıkıh literatüründe felsefeye dair ortaya konulmuş olan olumsuz yaklaşımların neler olduğunun ve hangi saiklerle bu sonuçlara varıldığının belirlenmesi, büyük önem arz etmektedir.Çalışmamızın konusu olan İslam fıkıh geleneğinin, felsefi faaliyetin dini hükmü hakkında ortaya koymuş olduğu olumsuz yaklaşımları, bu hususta Dr. Ahmet Selman Baktı tarafından hazırlanmış ve kapsamlı bir araştırmanın ürünü olan “Felsefenin “Hakikati” Konu Edinmesi “Caiz” mi?”başlıklı makaleden yola çıkarak ortaya koyacağız. Bilindiği gibi Kur’an-ı Kerim’de, aklı kullanmayı tavsiye eden pek çok ayet vardır. Fakihlerin, temel prensibi aklı kullanmak üzere şekillenen felsefeye yönelik eleştirileri ise bu gerçekle çelişmektedir. Aslında, bir ilim olarak fıkhın içtihada dayandığı, bunda da aklın kullanımını gerektiren kıyasın büyük bir payı olduğu bilinmektedir. Bu durumda fukaha, kendi kullandığı yöntemi kullandığı gerekçesi ile felsefeyi eleştiriyor demektir ki bu da açıkça totolojidir.
