The Procedures and Principles That Must Be Followed In Crime Investigations And Prosecutions Against Judges And Prosecutors

Abstract
Special authority and duty regulations, regarding the investigation andprosecution of personal crimes and crimes committed by judges andprosecutors about their duties or during their duties, are determined in theConstitution and the Code of Judges and Prosecutors, These regulations arethe requirements of the principles of "independence of courts" and "guaranteeof judgeship and prosecution". Three different investigation proceduresregarding the crimes committed by the judges and public prosecutors havebeen stipulated in the Code of Judges and Prosecutors; “the crimes arisingfrom duty or committed on duty” in the articles from 82 to 92 of the Code“the personal crimes” in the article 93, and “the flagrante delicto cases thatfall under the jurisdiction of the high criminal court” in the article 94.It is clearly stated in the Law which authority will carry out theinvestigation and which authority will conduct the prosecution in the criminalproceedings against judges and prosecutors. These principles, which havebeen determined regarding authority and duty, are special regulations ofprecise nature. It is not possible to conduct an investigation against themandatory provisions or by making a "mixed practice", regarding thesedifferent investigation procedures determined by the Law No. 2802 for theinvestigation and prosecution of judges and prosecutors.In order to have appropriate investigation against judges and prosecutors,all actions and decisions must be taken according to the investigationprocedure determined by the nature of the crime. If these procedures, whichare determined according to the type of crime, are violated or mixed practiceis made, the proceedings and decisions made will become invalid.

Anayasa’da ve Hakimler ve Savcılar Kanunu’nda hakimlerin ve savcıların görevleriyle ilgili veya görevleri sırasında işledikleri suçlar ile kişisel suçlarının soruşturulması ve kovuşturulması ile ilgili özel yetki ve görev düzenlemeleri belirlenmiştir. Bu düzenlemeler “mahkemelerin bağımsızlığı” ile “hakimlik ve savcılık teminatı” ilkelerinin bir gereğidir. Hâkim ve Cumhuriyet savcılarının işledikleri suçlara ilişkin; Hakimler ve Savcılar Kanun’un 82 ila 92. maddeleri arasında "görevden doğan veya görev sırasında işlenen suçlar", 93. maddesinde "kişisel suçlar" ve 94. maddesinde "ağır ceza mahkemesinin görevine giren suçüstü hâlleri" olmak üzere üç farklı soruşturma usulü öngörülmüştür. Hakim ve savcılar hakkında ceza yargılamasında hangi merciin soruşturmayı, hangi merciin kovuşturmayı yürüteceği kanunda açık ve net bir şekilde belirtilmiştir. Yetki ve göreve ilişkin belirlenmiş olan bu esaslar, kesin nitelikteki özel düzenlemelerdir. 2802 sayılı Kanun’un hakim ve savcıların soruşturma ve kovuşturmalarına yönelik belirlediği bu birbirinden farklı soruşturma usullerine ilişkin emredici hükümlere aykırı veya “karma uygulama” yapılarak soruşturma yürütülmesi mümkün değildir. Bir soruşturmanın hakim ve savcılar bakımından usulüne uygun olabilmesi için suçun niteliğine göre belirlenmiş olan soruşturma usulüne göre bütün iş ve işlemlerin, kararların alınmış olması gerekmektedir. Suç tipine göre belirlenmiş olan bu usullere aykırı hareket edilmesi veya karma uygulama yapılması halinde yapılan işlem ve kararlar hükümsüz hale gelecektir.
