Abstract

As it is known, the democratization process or constitutional movements in the Ottoman Empire period started with the Charter of Alliance. This process continued in the Tanzimat (1839), Reform Edicts (1856), and the First and Second Constitutional Periods. The foundation of the state was regulated with Kanun-i Esasi, and fundamental rights and freedoms were included; however, the sultan's powers were not fully restricted. Legislative, executive and judicial powers were removed from the intervention area of the Sultan with the arrangements made in the Constitution in the Second Constitutional Period.The Ottoman Parliamentary Assembly, which gathered in Istanbul on January 12, 1920 and accepted the National Pact, was dissolved on March 16, 1920 following the occupation of Istanbul and some of its members were exiled to Malta. In the face of this situation, Mustafa Kemal Pasha published a declaration on March 19, 1920, and announced that after the elections to be held, "a parliament with extraordinary powers" would convene in Ankara. After the elections held on this call, the Turkish Grand National Assembly was opened in Ankara on April 23, 1920. One of the most important duties of the Turkish Grand National Assembly was the adoption of the 1921 Constitution on January 20, 1921. The 1921 Constitution, on the other hand, is a short Constitution consisting of 23 articles, which did not include sections such as fundamental rights and freedoms, judicial power and the procedures to be followed regarding constitutional amendment. The 1921 Constitution is important in terms of placing the establishment of the Republic of Turkey on a legal basis and giving sovereignty to the nation. But the implementation of the 1921 Constitution seemed difficult given the conditions of the time it was adopted. This situation caused Canik (Samsun) Deputy Ahmet Nafiz Bey to submit a question statement to the Parliamentary Presidency on 16 June 1921 about why some articles of the 1921 Constitution were not implemented. In this study, the problem of the implementation/applicability of the 1921 Constitution has been tried to be examined by taking into account the articles on national sovereignty and civil administration in the Constitution.

Özet

Bilindiği üzere Osmanlı Devleti’nde demokratikleşme süreci ya da anayasacılık hareketleri Sened-i İttifakla başlamış, fasılalarla Tanzimat, Islahat, I. ve II. Meşrutiyet Dönemlerinde devam etmiştir. Kanun-i Esasi ile devletin kuruluşu düzenlenmiş, temel hak ve özgürlüklere yer verilmiş; bununla birlikte Padişahın yetkileri tam anlamıyla kısıtlanamamıştır. Anayasal gelişmeler II. Meşrutiyet Dönemi’nde de devam etmiş; yasama, yürütme ve yargı kuvvetleri Padişahın müdahale alanından çıkarılmıştır. 12 Ocak 1920’de İstanbul’da toplanan ve Misak-ı Millî’yi kabul eden Osmanlı Mebusan Meclisi, 16 Mart 1920’de İstanbul’un işgalini müteakip dağıtılmış ve üyelerinin bir kısmı Malta’ya sürgün edilmiştir. Bu durum karşısında Mustafa Kemal Paşa 19 Mart 1920 tarihinde bir beyanname yayımlayarak, yapılacak seçimlerden sonra “salâhiyat-ı fevkalâdeye malik bir meclisin” Ankara’da toplanacağını duyurmuştur. Bu çağrı üzerine gerçekleştirilen seçimlerden sonra 23 Nisan 1920’de Türkiye Büyük Millet Meclisi Ankara’da açılmıştır. Türkiye Büyük Millet Meclisi’nin yerine getirdiği en önemli görevlerden bir tanesi de, 20 Ocak 1921 tarihinde 1921 Anayasası’nı kabul etmiş olmasıdır. 1921 Anayasası ise temel hak ve özgürlükler, yargı kuvveti ve anayasa değişikliği hususunda izlenecek usuller gibi bölümlere yer vermemiş, 23 maddeden oluşan çerçeve bir Anayasa’dır. 1921 Anayasası, Türkiye Cumhuriyet Devleti’nin kuruluşunu hukukî bir zemine oturtması ve egemenliği millete vermesi bakımlarından önemlidir. Ancak 1921 Anayasası’nın ilgili maddelerinin hemen uygulanması, dönemin şartlarına göre mümkün olmamıştır. Bu durum Canik (Samsun) Mebusu Ahmet Nafiz Bey tarafından 18 Haziran 1921 tarihinde, 1921 Anayasası’nın bazı maddelerinin neden tatbik edilmediğine dair bir sual takririni Meclis Riyaseti’ne vermesine neden olmuştur. Bu çalışmada 1921 Anayasası’nın uygulanması/uygulanabilirliği sorunu, Anayasa’da yer alan milli egemenlik ve mülkî idareye ilişkin maddeleri göz önünde bulundurularak irdelenmeye çalışılmıştır.
