Duties of fatwa authorities in Ottoman State organization

Abstract

Fatwa authorities were assigned to assist shaykhs al-islam. When they were first assigned, their contribution in the process of preparing the Fatwa and its delivering to the concerning person was limited; but in time they became the most effective people in the process. Especially in the latest periods of Ottoman State, new duties and responsibilities as well as running the fatwa process were given to fatwa authorities. However, in the limited works that give information about the unit of Fatwa Authority or the fatwa authorities that are at the head of this unit, almost nothing is mentioned about their duties or responsibilities other than the ones in question. In this article, we will try to identify the duties of fatwa authorities within the frame of the data that resources present us with.

Özet

Fetvâ eminleri, fetvâ hizmetlerinde şeyhülislamlara yardımcı olmak üzere atanmıştır. İlk atandıklarında fetvânın hazırlanması ve ilgiliye ulaştırılması sürecine katkıları daha sınırlı düzeyde iken, zaman içerisinde bu alanda en etkili kişi konumuna yükselmişlerdir. Özellikle Osmanlı Devletinin son dönemlerinde fetvâ eminlerine, fetvâ sürecini yönetme görevinin yanı sıra ilave birtakım yeni görev ve sorumluklar verilmiştir. Ancak Fetvâ Eminliği birimi veya bu birimin başında bulunan fetvâ eminleri hakkında bilgi veren sınırlı sayıdaki çalışmalarda, bu kimselerin söz konusu görevi dışındaki vazife ve sorumluluk alanlarına hemen hemen hiç temas edilmemektedir. Bu makalede, kaynakların bize sunduğu veriler çerçevesinde fetvâ eminlerinin üstlenmiş olduğu görevlerin neler olduğu tespit edilmeye çalışılacaktır.
