HEAVY PENALTIES IMPOSED ON THE MILITARY PERSONNEL DURING THE PERIOD OF MAHMUT II (1823-1826)

Abstract
It is known that the period of Mahmut II was a depressive process for the Ottoman State in every field. Fundamental steps began to be taken in the name of modernization and the renewal of the military system was also realized in this period. The purpose of this study is to try to find answers to questions of how, why and for what duration severe punishment practices were applied to the military personnel. In addition, the differences and similarities between military penalties and those imposed on civilians are examined. This study classifies the severe penalty provisions applied to the military personnel in the abolition process of the Janissary Corps (between 1823-1826), which are the subject of the Kalebent Book Numbered 37. It further tries to clarify the types of crimes committed by military personnel, the types of heavy penalties they received, the places of punishment and the processes of ending the sentences. The severe punishments imposed on military personnel have been divided into two categories as exile and kalebent[prisoner in fortress]. 17 different types of crimes led to the punishment of exile, and 8 different types of crimes were punished with the penalty of imprisonment in a fortress. During the punishment process of military personnel, the authorized officer to which they were affiliated played an active role. In some cases, it was found that the punished military personnel were allowed to return to duty at the end of the term.

II. Mahmut döneminin Osmanlı Devleti için her alanda buhranlı bir süreç olduğu bilinmektedir. Modernleşme adına köklü adımlar bu dönemde atılmaya başlanmış ve askerlik sisteminin yenilenmesi de bu dönemde gerçekleşmiştir. Bu araştırmanın amacı, ağır ceza uygulamalarının askerî personele nasıl, neden ve ne süre ile uygulandığı sorularına yanıtlar bulmaya çalışmaktır. Ayrıca askerî cezalarla sivillere uygulanan cezaların fark ve benzerlikleri irdelenmiştir. Modernleşmeye engel teşkil eden Yeniçeri Ocağının kaldırılma sürecinde (1823-1826 yılları arası) 37 Numaralı Kalebent Defteri’ne konu olan askerî personele uygulanan ağır ceza hükümleri tasniflenmiştir. Askerî personelin işlediği suç türleri, aldıkları ağır ceza çeşitleri, cezalandırılma mahalleri ve cezaların sona erdirilme süreçlerine dair meseleler de aydınlatılmaya çalışılmıştır. Askerî personele uygulanan ağır cezalar sürgün ve kalebent olmak üzere iki kategoride şekillenmiştir. 17 ayrı suç türü sürgün cezasına, 8 ayrı suç türü de kalebentlik cezalarına sebep olmuştur. Askerî personelin cezalandırılma süreçlerinde bağlı bulundukları ocak yetkilisi etkin rol üstlenmiştir. Bazı durumlarda cezalandırılmış olan askerî personelin ceza süresi bitiminde göreve dönmesine müsaade edildiği bulgularına da ulaşılmıştır.
