The Outcomes of 3 November 2002 Parliamentary Elections from the Perspective of the Working of Parliamentary Regime in Turkey

Abstract
The parliamentary general elections of November 3, 2002 brought a two-party system in our political life again. The AK Party entered the parliament by obtaining a majority to form a single party government. However, the leader of the winning party couldn't be appointed as Prime-Minister due to his disqualification for not being a deputy. It is obvious that the traditional working patterns of parliamentary regime will be forced when one looks at the fact that the leader of the winning political party did not become Prime-Minister in the light of defining principles such as inclusiveness of legislative power, flexible separation of powers, superiority of legislature, the two-tiered executive, executive accountability before the legislature and the executive's right to dissolve parliament. On the other hand, it is needed to correct this situation which does not reflect the electoral preferences by finding a solution in harmony with the democratic principles.
Özet
3 Kasım 2002 milletvekili genel seçimleri, siyasal yaşamımıza iki partili sistemi yeniden getirmiştir. AK Parti, tek başına hükümet kurma olanağı tanıyan bir çoğunluk ile parlamentoda yerini almıştır. Ne var ki, bu seçimleri kazanan siyasal partinin lideri, milletvekili olmadığından başbakanlığa atanamamıştır. 3 Kasım 2002 seçimlerini kazanan liderin başbakanlık koltuğuna oturamaması olgusuna; yasamanın kapsayıcılığı, yumuşak güçler ayrılığı, yasamanın üstünlüğü, yürütmenin çift başlılığı, yürütmenin yasama önünde sorumluluğu ve yürütmenin yasamayı fesih hakkı gibi tanımlayıcı ilkeler ışığında bakıldığında, parlamenter rejimin geleneksel işleyiş kalıplarının zorlanacağı açıktır.
