Kemalist Authoritarianism, Military Courts and Constitutional Judiciary

Abstract
Pursuant to controversies regarding the Turkish Constitutional Court‘s decisions and position in Turkish politics, it is claimed that in Turkey, there is a “centre” called “Kemalist elites/bloc” consisting of army members, bureaucrats, judiciary and universities, whereas other groups constitute the “periphery”. Furthermore, it is asserted that the Turkish Constitutional Court was established to protect interests of central elites and that the Court operated according to its founding purpose. With emphasis to “Kemalist authoritarianism”, interest of the centre is to protect the state. This explanation is based on Şerif Mardin’s theory of “center-periphery relations” which is supported by Ran Hirschl’s theories of “hegemonic preservation” and “juristocracy”. The purpose of this article is to explain that the situation in Turkey cannot be explained by Mardin’s and Hirschl’s theories. Also it aims to propose that there is no integrity among the central actors regarding the protection of state. The military courts, the organ of the army, an actor involved in the centre, have shown a rather libertarian approach, demanding the unconstitutionality of many articles which restrict basic rights and freedoms. On the contrary, the Turkish Constitutional Court has rejected several claims of unconstitutionality made by the military courts.
Özet
Anayasa Mahkemesi, gerek verdiği kararlar gerekse Türkiye siyasetindeki konumu bakımından çeşitlitartışmaların odağı olmuştur. Bu tartışmalar çerçevesinde Türkiye’de anayasa yargısının benimsenme süreciniaçıklamaya yönelik bir teori sıkça ifade edilmektedir. Türkiye’de “Kemalist elitler/blok” olarak adlandırılanordu, bürokratlar, yargı organları ve üniversitelerin merkezi, bunun dışındaki kesimlerin de çevreyioluşturduğu, Anayasa Mahkemesi’nin de merkezin çıkarlarını korumak için kurulduğu ve kuruluş amacınauygun olarak faaliyet gösterdiği iddia edilmiştir. “Kemalist otoriterlik” olgusu vurgulanarak merkezin çıkarınındevletin korunması olduğu ileri sürülmüştür. Söz konusu açıklama girişiminin kaynağı Şerif Mardin’in“merkez-çevre ilişkileri” teorisi olup bu teori Ran Hirschl’ın “hegemonik koruma” ve “jüristokrasi” tezleri iledesteklenmiştir. Bu makalenin amacı Türkiye’deki durumun Mardin’in ve Hirschl’ın tezleri ileaçıklanamayacağını ve merkez unsurları arasında devletin korunması bakımından bir bütünlük olmadığınıortaya koymaktır. Merkeze dahil bir aktör sayılan ordunun organı olan askeri mahkemeler, temel hak veözgürlükleri sınırlandıran birçok hükmün iptalini isteyerek oldukça özgürlükçü bir yaklaşım sergilerkenAnayasa Mahkemesi ise birçok başvuruyu reddederek askeri mahkemelerden geri plana düşmüştür.
