On (the Myth of) the Separation of Powers in Montesquieu and the Modern Power of Judiciary

Abstract
The separation of the powers is a sine qua non-condition for democratic states governed by rule of law in our age. Locke is the processor of Montesquieu in respect of the theory of separation of the powers. The aim of Montesquieu was to save the interests and privileges of the nobles to which he was a member too. In this article, I claim Montesquieu tried to protect the interests and privileges of nobles not only in a monarchy but also in other forms of government. So, why is Montesquieu important for the separation of the powers? His importance comes from the manner and timing of doctrine’s development in his hands. Therefore we should read him under the framework of rule of law and this reading necessarily force us to give special importance to constitutional jurisdiction
Özet
Montesquieu tarafından ortaya atıldığı sanılan ama asıl öncüsü Locke olan erkler ayrımı, günümüz demokratik hukuk devletlerinin olmazsa olmazıdır. Montesquieu’nün kuramı ortaya atarken güttüğü amaç, üyesi olduğu soylular sınıfının çıkarlarının korunmasıdır. Bu makalede bu amacın bütün yönetim biçimleri için savunulduğu gösterilmeye çalışılmaktadır. Dolayısıyla Montesquieu’yü günümüz erkler ayrımı kuramı açısından önemli yapan şey söylediklerinden çok, kuramı ortaya attığı zaman ve kuramın bu zamanın düşünceleri üzerinde yarattığı etkidir. Bu yüzden Montesquieu’y kendi zamanının içinden okumak yerine demokratik hukuk devletinin günümüzde geldiği noktadan okumak gerekir. Bu okuma, egemenliği kullanan erklerden biri olan yargı erkine ve özellikle anayasa yargısına özel bir önem vermeyi zorunlu kılar.
