Principle of Concentration in Civil Procedure

Abstract

The principle of concentration is a jurisdiction principle which envisages the case material to be submitted to the court up to a certain procedural transactions and it also requires the court to disregard those put forward afterwards. The principle of concentration is not referred in the Code of Civil Procedure (Act No. 6100). However its reflections are observed in its certain items. Hence, the principles of concentration is an essential tenet considered both by the supreme court and doctrine. In this article, the principle of concentration will be explained in detail in terms of its concept, its purpose, its relationship with other dominating jurisdiction principles and its legal remedy.

Özet

Teksif ilkesi, usul işlemlerinin, belirli bir usul kesitine kadar mahkeme önüne getirilmesini, öngörülen usul kesitinin tamamlanmasından sonra ileri sürülen ya da getirilen işlemlerin mahkemece dikkate alınmamasını öngören yargılama hukuku ilkesidir. HMK’da düzenlenmemiştir. Ancak gerek Yargıtay tarafından gerekse de doktrin tarafından göz önünde bulundurulan bir ilke konumundadır. Bu çalışma kapsamında da teksif ilkesi kavram, yargılamaya egemen olan diğer ilkeler ile ilişkisi, uygulama alanı ve kanun yolunda bakımından ayrıntılı olarak açıklanmaya çalışılacaktır.
