İstibdal in the Foundations According to the Ottoman Law

Abstract

The foundation is a religious and legal institution that served important services in Islamic states, especially in the Ottoman Empire. The goods that bring income to the foundation play an important role in the realization of the purpose of the foundation. However, over time, the foundation property may be destroyed for various reasons and become unusable. In this case, it becomes necessary to replace the foundation property that has lost its function with a new property that will serve the foundation. Istibdal, in the most general sense, is the replacement of a foundation property with another property that is estate. The fact that there are different opinions about changing the foundation property among sects in Islamic law has made the issue of istibdal a controversial issue both in terms of theoretical and practical aspects. Since the continuity of the foundation depends on the income of the foundation's property, the process of istibdal was a method frequently used in Ottoman law as a solution. In this article, the issue of istibdal of the foundations in the Ottoman Empire has been discussed in terms of its legal dimensions. In our research information about the reasons for istibdal, the application method and the procedure applied was given by examining the subject of istibdal in the light of the records of Shari’iyya Courts and some archive documents obtained from the Ottoman Archive.

Özet

Vakıf, İslam devletlerinde, özellikle de Osmanlı Devleti’nde önemli hizmetler görmüş dini ve hukuki bir kurumdur. Vakıf amacının gerçekleşmesinde vakfa gelir getiren malların önemli bir rolü vardır. Ancak zaman içinde vakıf malı çeşitli nedenlerle harap olabilir ve kullanılamayacak hale gelebilir. Bu durumda, işlevini yitiren vakıf malının vakfa hizmet edecek olan yeni bir mal ile değiştirilmesi zorunluluk arzeder. İstibdal, en genel anlamıyla bir vakıf malının mülk olan bir başka mal ile değiştirilmesidir. İslam hukukunda mezhepler arasında vakıf malının değiştirilmesi konusunda farklı düşünceler olması istibdal konusunu hem teorik açıdan, hem de uygulama açısından tartışmalı bir konu haline getirmiştir. Vakfın devamlılığının sağlanması vakıf malının gelir getirmesine bağlı olduğundan istibdal işlemi bir çözüm yolu olarak Osmanlı hukukunda da sıklıkla başvurulan bir yöntem olmuştur. Bu makalede Osmanlı Devleti’nde vakıfların istibdali meselesi hukuki boyutları ile ele alınmaktadır. Araştırmamızda şer’iyye mahkemesi sicillerinden ve Osmanlı Arşivinden elde ettiğimiz bazı arşiv belgeleri ışığında istibdal konusu incelenerek, istibdal nedenleri, başvuru şekli ve uygulanan usul hakkında bilgiler verilecektir.
