The Use of Satellite Imagery as Evidence before the International Court of Justice

Abstract
The data obtained by remote sensing satellites are increasingly used in various fields. Recently, these data have been frequently used as evidence, especially in the proceedings of national and international courts. There are many human/computer interventions from the processing of the raw data obtained by the remote sensing satellite to the final product. Therefore, the main issue here is the reliability of satellite data. Within the scope of this study, we will focus on the practice of the International Court of Justice concerning satellite data as a mode of proof. In this context, issues such as the admissibility of satellite data and evidential weight in the Court proceedings will be discussed.
Özet
Uzaktan algılama uyduları tarafından elde edilen verilerin kullanım alanı gün geçtikçe artmaktadır. Son dönemde, bu verilere özellikle ulusal ve uluslararası mahkemelerin yargılama sürecinde kanıt olarak başvurulmaya başlanmıştır. Uzaktan algılama uydusu tarafından elde edilen ham verinin işlenmesinden son ürün olana kadarki süreçte birçok insan/bilgisayar müdahalesi bulunmaktadır. Bu nedenle, uydu verilerinin güvenilirliği önemli bir mesele oluşturmaktadır. Bu çalışma Uluslararası Adalet Divanı önündeki davalarda uydu verilerinin kanıt olarak nasıl bir yer tuttuğu üzerine yoğunlaşacaktır. Bu bağlamda, uydu verilerinin kabul edilebilirlikleri ve kanıt değeri gibi meseleler ele alınacaktır.
