PROTECTING RIGHT TO EDUCATION IN TRANSFER OF PUBLIC SERVANTS BY APPOINTMENT

Abstract

In this article, transfer is used meaning briefly the appointment of a public servant from a post at one place to another. We have tried to state the particulars in the appointments which include transfer procedures, the considerations which must be taken in to account in transfer procedures and which features the administration should observe when using it s discretionary powers and how these powers should be exercised in the application of these procedures. We have particularly mentioned the Council of State decisions where the supreme court has given opinions referring to what caution should be given in using discretionary powers in transfer procedures by appointment.

Nakil, kısaca memurların bir yerden başka bir yerdeki göreve atanması anlamında kullanılmaktadır. Bu çalışmada nakil işlemlerinde eğitim hakkının gözetilmesi ve nakil işlemlerinde göz önünde bulundurulması gereken durumlar ile bu işlemleri yaparken idarenin takdir yetkisini ne şekilde ve hangi özellikleri göz önünde tutarak kullanacağının belirtilmesine çalışılmıştır. Özellikle naklen atama işlemlerinde eğitim hakkının kullanılmasına ilişkin durumlarda nelere dikkat edilmesi gerektiği hususunda Danıştayın görüşlerini belirttiği Danıştay kararlarına yer verilmiştir.
