AN ASSESSMENT OF ELECTRONIC COMMERCE CODE IN LIGHT OF FREE MARKET ECONOMY PRINCIPLES

SERBEST PİYASA EKONOMİSİ İLKELERİ IŞIĞINDA ELEKTRONİK TİCARET KANUNUNUN DEĞERLENDİRİLMESİ

Abstract

In this study, Regulation of Electronic Commerce Code, 6563 Numbered, was examined in the light of free marketeconomy principles. The free market economy is an economic system, which has left to solve the economicproblems to market mechanism. In this system, it is essential that inviduals will exchange according to theirpreferences, which depend on price mechanism. In this context, the elements of the free market economyhas been identified as private property, freedom of contract, free enterprise and competition. In this system,the Government duty is to make legal arrengements that make up the ambience in a way that can providefree decisions. The arrangements in the Electronic Commerce Code, essentially, is concerning to creating thatambience in the electronic commerce. However, in the context of a free market economy it is also shortcomingsto be held in the Electronic Commerce Code.

Özet

Bu çalışmada, 6563 sayılı Elektronik Ticaretin Düzenlenmesi Hakkında Kanun, serbest piyasa ekonomisi ilke- leri ışığında değerlendirilmiştir. Serbest piyasa ekonomisi, iktisadi sorunların çözümünü piyasa mekanizması- na bırakan ekonomik düzendir. Bu düzende, bireylerin fiyat mekanizmasına bağlı olarak kendi tercihlerine göremübadelede bulunmaları esastır. Bu bağlamda, serbest piyasa ekonomisinin unsurları, özel mülkiyet, sözleşmeözgürlüğü, serbest girişim ve rekabet olarak belirlenmiştir. Bu sistemde devlete düşen görev, alıcı ve satıcının,serbest bir şekilde karar almasını sağlayabilecek ortamı oluşturan hukuki düzenlemeleri yapmaktır. ElektronikTicaret Kanununda yer alan düzenlemeler, esasen, söz konusu ortamı elektronik ticarette oluşturmaya yöneliktir.Bununla birlikte serbest piyasa ekonomisi bağlamında Elektronik Ticaret Kanununda düzenlenmesi gereken ek- siklikler de bulunmaktadır.
