THE STATE OF EMERGENCY MEASURES IN TURKEY WITH REGARD TO THE ARTICLE 15 OF THE EUROPEAN CONVENTION ON HUMAN RIGHTS (ECHR)

Abstract

Following the failed military coup on 15 July 2016, the Council of Ministers declared a nationwide state of emergency on July 20, 2016 for 90 days. After this decision, the state of emergency was extended seven times, for a period of three months by the decision of the Council of Ministers and the necessary notification was made to the Secretary General of the Council of Europe. As a State Party to the ECHR, Turkey has notified the Council of Europe that it has taken the Standing of the ECHR in accordance with article 15. However, in order to avoid abuse of this right recognized in the State, article 15 (derogation in time of emergency) of the European Convention on Human Rights (ECHR) affords to the governments of the States parties, in exceptional circumstances, the possibility of derogating, in a temporary, limited and supervised manner, from their obligation to secure certain rights and freedoms under the Convention. European Court of Human Rights (ECHR) produced a vigilant jurisprudence for state of emergency that could apply to Turkey. Although the Court has proposed three conditions for the suspension of its obligations under article 15 of the ECHR, in this work it will be dealt with justifying the application of a state of emergency with the obligation to give notice. When the ECHR norms and the Court’s case law were examined, it reveals that these two conditions in Turkey comply with the terms of the legal framework drawn by the Convention.

15 Temmuz 2016 tarihli başarısız askeri darbe ardından, Türkiye’de Bakanlar Kurulu 20 Temmuz 2016 tarihinde 90 gün süreyle ülke genelinde olağanüstü hal (OHAL) ilan etmiştir. 21 Temmuz 2016 tarihinde Türkiye yetkili makamları, Avrupa Konseyi Genel Sekreteri’ne, Avrupa İnsan Hakları Sözleşmesi’nin (AİHS) 15. maddesi uyarınca derogasyon (olağanüstü hallerde yükümlülükleri askıya alma) hakkını kullandığını bildirmiştir. OHAL, Bakanlar Kurulu Kararı ile bugüne kadar yedi kez, üç ay süreyle uzatılmış ve Avrupa Konseyi Genel Sekreteri’ne gerekli bildirimler yapılmıştır. Avrupa İnsan Hakları Sözleşmesi’nin OHAL dönemlerinde belirli hakların askıya alınmasına olanak sağlaması şüphesiz çok önemlidir. Ancak, AİHS’in 15. maddesi, bu mekanizmanın kötüye kullanılmaması için, taraf devletlere, istisnai koşullarda, Sözleşme kapsamındaki yükümlülüklerini geçici, kısıtlı ve denetimli bir şekilde askıya alma imkânı sunmaktadır. Avrupa İnsan Hakları Mahkemesi (AİHM), olağanüstü hallere ilişkin Türkiye için de geçerli olabilecek ihtiyatlı bir içtihat ortaya koymuştur. AİHS’in 15. maddesi kapsamında yükümlülüklerinin askıya alınmasına ilişkin Mahkeme, üç koşul ileri sürmekteyse de bu çalışmada sadece bildirimde bulunma yükümlülüğü ile olağanüstü hal yoluna başvurunun gerekçelendirilmesi konuları ele alınacaktır. AİHS normları ve AİHM’in içtihadı incelendiğinde, bu iki koşul açısından Türkiye’nin AİHS’in çizdiği hukuki çerçeveye uyduğu görülmektedir.
