Abstract

Objective: The notaries, courts, directo- rates of land registry and other institutions request reports from physicians about the ability to perceive the legal meaning and consequences of the act for the geriatric age group. In this study, the reports drawn up on this is- sue in our city has been evaluated and emphasizing the encountered problems is aimed. Methods: The cases aged 65 and over, who were referred to the Council of Forensic Medicine Eskişehir Branch Office in a six-month peri- od for the actual motion capability and civil competency reports were included in the study. Results: It was detected that 367 cases (58.7%) were females, average age was 75±5.3. Fifty-three ca- ses (8.5%) were determined to be analphabet. The reports were drawn up for 79 cases (12.6%) sta- ting that the individual was unable to perceive the juridical meaning and consequences of the act and for 546 cases (87.4%) stating that the individual was able to perceive the juridical meaning and conse- quences of the act. Conclusion: In order to prevent the economic abuse of the elderly individuals, the rule indicating which expertsdrawing up the civil liability re- ports for this age group is goingbecorrect should be determined through legal regulations. The extension of the validity periods of these reports by official autho- rities is suggested to reduce the victimization related to this topic.

Özet

Amaç:Noterlikler, mahkemeler, tapumüdürlükleri ve benzeri kurum-lar, hekimlerden, geriatrik yaşgrubu için, fiilin hukuki anlamve sonuçlarını algılama yeteneğiile ilgili olarak rapor istemek-tedir. Bu çalışmada ilimizde bukonuda düzenlenen raporlar de-ğerlendirilmiş, karşılaşılan ak-saklıkların vurgulanması amaç- lanmıştır. Yöntemler:Altı aylık dönemde EskişehirAdli Tıp Şube Müdürlüğünehukuki (fiili) ehliyet raporu içinmüracaat ettirilmiş 65 yaş veüzeri olgular çalışma kapsamı-na alınmıştır.Bulgular:Yaşlıların 367sinin (%58,7) ka-dın olduğu, yaş ortalamasının75±5,3 olduğu saptanmıştır.Yaşlıların 53ünün (%8,5) oku-ma yazmasının olmadığı belir-lenmiştir. Yaşlıların 79unun(%12,6) ilgili fiilin hukuki anlamve sonuçlarını algılama yetene-ğinin gelişmediği, 546sının (%87,4) ise geliştiği yönünde rapordüzenlenmiştir. Sonuç:Yaşlıların ekonomik istismara maruz kalmalarının önüne ge-çilmesi açısından, bu yaş gru-buna verilecek hukuki ehliyetraporunun hangi uzmanlarcaverilmesinin uygun olacağı yasaldüzenlenmeyle belirlenmelidir.Resmi makamların, raporlarıngeçerlilik sürelerini uzatmala- rı bu konuyla ilgili mağduriyetiazaltmak üzere önerilmektedir.
