AN EVALUATION ON THE APPOINTMENTS OF TRUSTEES TO THE MUNICIPAL

Abstract

Turkey’s central government is experiencing a lot of discussion with the shape of the relationship between local governments. The central government uses a number of administrativei tutelaga tools on the local authorities. These custody bodies used by the central government in their relationship with local authorities should encourage the development of an effective local government system to accelerate development, mitigate the burden of central government. Otherwise, it may reduce the participation of citizens in local governments and eliminate local responsibility. Turkey on July 15, 2016 the treacherous coup attempt by the Emergency Period 674 numbered Law declared Decree (Decree) with significant local governments, changes have occurred and to assign my tutelaga authorities trustee of the mayoral administration was introduced. In this framework, the aim of this study is to explain the effects of the application of the trust with local government, the reasons for the application of the trustees, the regulations for the services provided by the application and the problematic areas of the application.

Özet

Türkiye’de merkezi yönetimler ile yerel yönetimler arasındaki ilişkininşekli konusunda bir çok tartışma yaşanmaktadır. Merkezi yönetim, anayasa veilgili kanunlar aracılığıyla yerel yönetimler üzerinde idari vesayet denetimindebulunmaktadır. Merkezi yönetimin yerel yönetimlerle olan ilişkisinde kullandığıbu vesayet denetiminin kalkınmayı hızlandırıcı, merkezi yönetimin yükünühafifletici ve etkin bir yerel yönetim sistemini teşvik edici olması beklenmektedir.Aksi taktirde vatandaşların yerel yönetimlere katılımı azalabilecek ve yerelsorumluluk bilinci de ortadan kalkabilecektir. Türkiye’de 15 Temmuz 2016hain darbe girişimi ile ilan edilen Olağanüstü Hal Döneminde, 674 sayılı KanunHükmünde Kararname (KHK) ile yerel yönetimlerde önemli değişiklikler meydanagelmiş ve belediye başkanlıklarına vesayet makamlarınca “kayyum” atanmasıuygulaması getirilmiştir. Bu çerçevede, çalışmada kayyum uygulamasının yerelyönetimler üzerindeki yansımaları, kayyum uygulamasının ortaya çıkış sebepleri,uygulamanın getirdiği hizmetlere yönelik düzenlemeler ve uygulamanın sorunlualanları açıklanmaya çalışılmıştır.
