TREATISE ON REASONS FOR POSTPONEMENT OF EXECUTION OF A SENTENCING WITH REFERENCE TO CURRENT DEVELOPMENTS

Abstract

Postponement of execution of a sentence is an institution which aims at rehabilitation, and which can be invoked when conditions prescribed by the Law on Execution of Penal Sentences and Sanctions are fulfilled. Postponement of execution is an exception to the rule of uninterrupted execution of a sentence, and execution will continue from the moment that the reasons for its postponement cease to exist. Within this framework, postponement of a prison sentence is an institution for interruption of execution which can ve invoked before or during the execution of a prison sentence. Conditions for postponement of execution have been amended by the Law No. 7242 and scope of application of some of the conditions have been extended. This article elaborates on the nationwide effects of the Covid-19 pandemic and specifically on postponement of execution on grounds of illness.

Özet

Bir ceza infaz kurumu olarak cezanın infazına ara verilmesi için- de yer alan cezanın infazının ertelenmesi, hükümlünün topluma kazandırılması amacını taşıyan, CGTİK’da öngörülen koşulların var- lığı halinde uygulanabilen bir müessesedir. İnfazın kesintisizliği ku- ralına bir istisna teşkil eden cezanın infazının ertelenmesi, infaza ara verme olup, ara vermeyi gerektiren koşulların ortadan kalkması ile kaldığı yerden devam eder. Bu çerçevede cezanın infazının erte- lenmesi, hapis cezasının infazına başlanmadan ya da infaz sırasın - da başvurulabilen bir ara verme müessesesidir. Şartlarının kanunda belirtildiği cezanın infazının ertelenmesi 7242 sayılı Kanunla bazı değişikliklere uğramış ve birtakım şartlarının uygulama alanı geniş - letilmiştir. Bununla birlikte Covid-19 pandemisinin ülkenin geneline etkisi, hükümlülerin durumu bakımından da tartışılmış ve bunun bir hastalık sebebiyle cezanın infazının ertelenmesi sebebi teşkil etmesi üzerinde durulmuştur.
