Bonzai: The Sentetic Cannobinoids of Narcotic in the Crimes of Drug Traffics

Abstract

Drug use and trafficking appear as examples of the biggest, dangers against public health and public order in Turkey just as in the world. Th at is source of danger has recently brought out another one, called synthetic cannabinoids. The Turkish authorities, from both medical and forensic point of view, have become experienced regarding heroin, cocaine and similar drugs for many years. However, synthetic cannabinoids moves ahead contrary to what has been well-known by the authorities on drugs so far. Because, its components can be subject to changes frequently and as such, law enforcement and judicial authorities may have a difficulty or challenges in both detecting the traces of this new drug type and in intervening its use and trafficking. Indeed, it is highly urgent to figure out the motives of the perpetrators who are caught by the authorities with various amount of synthetic cannabinoids in their possession. Via making a general classification of drugs, synthetic cannabinoids will be introduced by this study. Then, determining the effects of synthetic cannabinoids on human health by medical data, related directly with our topic and with the aim of using by drug trafficking crime, general statements will be made about crimes of buying drugs or stimulants, accepting or possession. As it is known, both types of crimes are wide enough to be the subject of another study. Finally chosen from the decisions of Supreme Court and Regional Courts of Justice and can be considered as criteria with the help of specific laws, in the absence of supporting evidence, related with the amounts of synthetic cannabinoids for personal and commercial use, a concrete measure will be tried to be established by this study.

Özet

Uyuşturucu madde kullanımı ve ticareti, tüm dünyada olduğu gibi ülkemizde de toplum sağlığı ve kamu düzeni için en önemli tehlikeler arasındadır. Son zamanlarda bu tehlike, kendi içinde yeni bir tehlike daha doğurmuştur: Sentetik kannabinoidler. Eroin, kokain, esrar gibi bilindik uyuşturuculara karşı gerek tıbbi gerek de adli müdahale tecrübesi uzun yıllardır oluşmuştu; ancak sentetik kannabinoidler, bilinenin dışında bir seyir izlemektedir. Bileşenlerinin sürekli değiştirilmesi, tedavi süreçlerini olumsuz etkilediği gibi, kolluk ve adli otoriteleri de tespit ve müdahale süreçlerinde geride bırakmaktadır. Oysaki kendilerinde çeşitli miktarlarda sentetik kannabinoid yakalanan faillerin, bunları hangi saikle bulundurduklarının tespiti ivedilik arz etmektedir. Bu çalışmayla uyuşturucu maddelerin genel bir sınıflandırması yapılarak sentetik kannabinoidler tanıtılmaya çalışılacaktır. Sonrasında sentetik kannabinoidlerin insan sağlığına etkileri, tıbbi veriler doğrultusunda tespit edilerek konumuzla doğrudan ilgili olması bakımından uyuşturucu madde ticareti suçu ile kullanmak amacıyla uyuşturucu veya uyarıcı madde satın almak, kabul etmek veya bulundurmak suçlarına dair genel açıklamalarda bulunulacaktır. Malum olduğu üzere her iki suç tipi, bir başka çalışmanın konusunu oluşturacak kadar geniş kapsamlıdır. Son olarak Yargıtay ve Bölge Adliye Mahkemelerinin kararlarından seçilmiş ve kıstas sayılabilecek belirli içtihatlar yardımıyla, yan delillerin olmadığı hallerde sentetik kannabinoidlerin şahsi kullanım ve ticari amaçlı bulundurma miktarlarına dair somut bir ölçü oluşturulmaya çalışılacaktır.
