Exception Requests of Various Foundatıons after Reform in Evkaf Administrations

Abstract
Ottoman State XIX. Since the beginning of the century, it has started to make reforms in the administration. Foundations administrations have also been affected by the process that started with the establishment of the Ministry of Foundations. Centralization has maintained by first establishing a center and then provincial administrations. In the following process, the administration of all foundations, except for the eight items of foundations, called evkaf-ı müstesna has left to the Ministry of Foundations. After the announcement of the Tanzimat, it was exempted from the exceptional foundations tâşir. The aforementioned foundations are excluded as they used to be. On various dates thereafter, many foundation made requests for exceptions. Among the claimants, there were those whose exception was accepted. Therefore, the number of exempted foundations has increased. When it came to 1890, the exception of all foundations except for the exceptional foundations, four of which were Eizze-i Kiram and four of which were Guzat-i Izam, were abolished and it was decided that the administration and arrangement of these foundations would be carried out by the Treasury. After this decision, many foundations trustees, whose exceptions were abolished, renewed their exemption requests, claiming that their foundations were from exceptional foundations. But unfortunately the law enacted in 1890 was renewed in 1913 as well. Therefore, in this study, the foundations that wanted to be included in the exception on various dates were examined by listing them in items. The documents of desire given by such foundation trustees have been identified from the archive. After the investigations and researches carried out by the center, it was understood that the exception of a few of the foundations mentioned was accepted for a while, but the demands of the majority were not accepted.
Özet
Osmanlı Devleti, XIX. yüzyılın başlarından itibaren idarede ıslahat yapmaya başlamıştır. Özellikle EvkafNezaretinin kurulmasıyla başlayan süreçten evkaf idareleri de etkilenmiştir. Merkezileşme, önce merkez sonrail idareleri kurularak sürdürülmüştür. İlerleyen süreçte, Evkâf-ı Müstesnâ adı verilen sekiz kalem evkaf dışındakalan bütün vakıfların idaresi Evkaf Nezaretine bırakılmıştır. Tanzimatın ilanından sonra Evkâf-ı Müstesnâtâşirden1 istisna edilmiştir. İstisna edilen bu vakıflar Mevlânâ Celâleddîn-i Rûmî (Evkaf-ı Celâliye), HacıBektâş-ı Velî, Abdülkâdir-i Geylânî, Hacı Bayrâm-ı Velî, Gazi Mihal, Ali ve Süleyman Beyler ile Gazi EvrenosBey vakıflarıdır. Adı geçen vakıflar, eskiden olduğu gibi, müstesna tutulmuştur. Bundan sonra çeşitli tarihlerdebirçok evkaf istisnaya dâhil olmak için talepte bulunmuştur. Talepte bulunanlar arasında istisnaiyeti kabuledilenler olmuştur. Dolayısıyla istisna edilen evkafın sayısı artmıştır. 1890 yılına gelindiğinde, adı geçen dördü Eizze-i Kiram, dördü Guzat-ı İzam olan müstesna evkafın dışında kalan bütün vakıfların istisnalığı kaldırılmışve bu vakıfların idaresi ile tâşirinin, Maliye Hazinesi tarafından yürütülmesi kararı alınmıştır. Bu karardansonra istisnaiyeti lağvedilen birçok evkaf mütevellisi, vakıflarının müstesna vakıflardan olduğunu iddia ederek,istisnaiyet taleplerini yenilemişlerdir. Ancak 1890’da çıkarılan kanun, 1913’te de yenilenmiştir. Dolayısıyla buçalışmada, çeşitli tarihlerde istisnaya dâhil olmak isteyen vakıfların talepleri ile ilgili süreç TürkiyeCumhuriyeti Cumhurbaşkanlığı Devlet Arşivleri Başkanlıığı arşivlerinden temin edilen vesikalar ışığındaincelenmiştir. Bu tür vakıf mütevellileri tarafından verilen arzuhal belgeleri, arşivden tespit edilmiştir. Merkeztarafından yürütülen inceleme ve araştırmalardan sonra, adı geçen vakıflardan çok azının istisna olmasının birsüreliğine kabul edildiği, çoğunun talebinin kabul edilmediği anlaşılmaktadır.
