Border as a legal-material category: Smuggling in the Turkish-Iranian border, legal processes, and everyday construction of the official borders

Abstract

Sociological and anthropological studies show how the official borders, as markers of state sovereignty, lead to various expected as well as unexpected so- cial, political, and economic limits and/or possibilities. Historical studies unpack and examine border-drawing processes, ranging from diplomatic practices to the cartographic techniques. Inspired by these studies, this article aims to contribute to the border studies through addressing how official representations of the borders are constructed through everyday practices in the courts. Examin- ing investigation and prosecution processes of the smuggling cases of oil, ciga- rettes, and foodstuff in Van city center and four border towns (Çaldıran, Özalp, Saray, Başkale), the article shows that borders of the nation-state and the na- tional market are negotiated and re-constructed through everyday courting practices. Through its analysis of the court sessions, documents, and expert wit- nesses, the article indicates how borders, border crossings, and/or border crossing person/thing are legally and materially formulated in different and contending ways. It further marks that those formulations could be registered in the legal system through precedent decisions. Furthermore, the article demonstrates that the legally and materially constructed official representations of borders and smuggling are informed by the pro-Kurdish political struggle and armed conflict. For instance, it discusses how oil smuggling, as a violation of the national market boundaries, could be instead reframed as a national security threat and hence identified with terrorism. In the context of the border studies, the article brings legal anthropology and science-technology studies together. On the one hand, it formulates legal processes as contingent discursive and materi- al practices as opposed to the positivist legal analysis. On the other hand, it examines material-technical processes regarding both the scientific-technical field, and contemporary political and social context.

Özet

Sınır çalışmaları devletlerin egemenlik alanlarını işaretleyen resmî sınırların öngörülen ve öngörülmeyen birçok toplumsal, siyasal ve iktisadi kısıt ve/veya imkan yarattığını gösterdi. Tarihsel çalışmalar resmî sınırların diplomatik pratiklerden haritalama tekniklerine kadar hangi süreçlerle çizildiğini inceledi. Bu çalışmalardan esinlenen makale, sınırların resmî temsillerinin mahkemelerde hangi gündelik pratiklerle kurulduğu sorusunu gündeme getirerek sınır çalışmalarına katkı sunmayı amaçlamaktadır. Van ilindeki petrol, sigara ve çeşitli gıda maddesi kaçakçılığı olaylarının soruşturulma ve mahkeme edilme süreçlerini antropolojik bir perspektifle inceleyen makale, ulus-devletin siyasal sınır çizgileriyle ulusal piyasa sınırlarının resmî temsillerinin gündelik mahkeme pratikleri üzerinden nasıl kurulduğunu tartışmaktadır. Bunu yaparken, sınırın, sınır geçişinin ve/veya sınırı geçen kişi veya eşyanın hukuki ve maddi olarak nasıl farklı ve karşıt biçimlerde formüle edildiğini tespit etmektedir. Ayrıca makale, sınır ve kaçakçılığın hukuki ve maddi kategoriler olarak kurulan resmî temsillerinin Türk Silahlı Kuvvetleri ile Kürdistan İşçi Partisi (PKK) arasındaki savaş ve çatışma bağlamında şekillendiğini petrol örneği üzerinden anlatıyor. Ulusal piyasanın sınırlarını ihlal eden kaçak akaryakıtın, ulusal güvenlik tehditi olarak yeniden formüle edilip, terörizm ile özdeşleştirildiğini göstermektedir. Makale bir yandan positivist hukuk analizlerine karşı hukuki süreçleri olumsal söylemsel ve maddi pratikler olarak formüle etmekte, bir yandan da maddi-teknik süreçleri güncel siyasal ve toplumsal bağlamla birlikte analiz etmektedir.
