Abstract

The main purpose of social security systems is to give the individual and his family a sense of security and spare them worries about future by guaranteeing their future against various risks. One of the risks that individuals may encounter during their life is unemployment. Unemployment is a source of problems that prevents both economic and societal peace. Therefore, struggling unemployment is of vital importance. Struggling unemployment is generally realized in two ways by eliminating either the causes of unemployment or the negative consequences of it. These two methods should not bethought of as alternatives but complementary to each other. Unemployment insurance is a social policy instrument that aims to alleviate economic and social problems caused by unemployment. The studies that started in 1959 in Turkey resulted in the 4447 no. Law in 1999. In this study, the Unemployment Insurance Law is presented under a general framework and the development of practice of the unemployment law since the it was put into effect and the problems experienced in the system are analyzed. Additionally, the function of the 4447 no. Unemployment Insurance Law in erasing the adverse consequences of unemployment is given in detail.

Özet

Sosyal güvenlik sistemlerinin temel amacı, insanların geleceklerini çeşitli risklere karşı teminat altına alarak birey ve ailesine güven duygusu vermek, onları gelecek endişesinden kurtarmaktır. Bireylerin yaşamları boyunca karşı laşabilecekleri risklerden birisi de işsizliktir. İşsizlik, toplumlar için gerek ekonomik gerekse toplumsal barışın sağlanmasını engelleyici bir sorun kaynağıdır. Bu nedenle işsizlikle mücadele çok büyük önem taşımaktadır. İşsizlikle mücadele genelde, işsizliğin nedenlerini giderici ve yarattığı olumsuz sonuçları giderici olmak üzere iki şekilde gerçekleştirilmektedir. Bu iki yöntem birbirinin alternatifi değil birbirinin tamamlayıcısı olarak düşünülmelidir. İşsizlik sigortası, işsizliğin ortaya çıkardığı ekonomik ve sosyal sorunları hafişetmeyi amaçlayan sosyal politika aracıdır. Türkiye’de ilk defa 1959 yılında başlanan işsizlik sigortası çalışmaları, 1999 yılında çıkarılan 4447 sayı- lı yasa ile sonuçlandırılmıştır. Bu çalışmada söz konusu İşsizlik Sigortası Kanunu genel hatlarıyla ortaya konmaya çalışılarak, Kanunun yürürlüğ e girmesinden bugüne kadar Türkiye’deki işsizlik sigortası uygulamasının gelişimi ve bu sistemde yaşanan temel sorunlar üzerinde durulmaya çalışılmıştır. Ayrıca 4447 Sayılı İşsizlik Sigortası Kanununun işsizliğin yol açtığı olumsuzlukları gidermesindeki işlevi üzerinde ayrıntılı olarak durulmuştur.
