Islamic law legal nature of the relationship between doctors and patients

Abstract

In between doctor and patient, two separate legal relationships that are essential to the responsibility of the physician may be mentioned. These are the relationship of the contract and in tort. In most of the events where the responsibility of the physician is discussed, has a contractual relationship in between doctor and patient. As a rule, the physician treat the patient under the base of an agreement made between them. For this reason, the contractual responsibility is generally the responsibility of the physician Between the physician and the patient, the physician’s action for the provision of fee, in the cases of treat for limited in time, the service contract shall be applied. If that case is for the aim of achievement or creation exception contract should be applied. In any manner whatsoever the subject of the contract, its purpose, due to the situation in which the parties present during the contract agreement between the physician and the patient can be named as a treatment contract.
