An evaluation of the case-law of the European court of human rights on euthanasia

Abstract

As a conclusion from the research on the euthanasy related case law of the European Court of Human Rights, it seems possible to state that the Court’s approach to euthanasia has became more flexible in time. But the Court should be firm in stating that euthanasia cannot be regarded as a right. It is impossible to accept that the Contracting States have margin of appreciation in legalising euthanasy. “Object of the Convention” and the “right to life” which is protected under the 2 nd Article of the Convention are the interpretation tools which enable to reach this conclusion. Moreover, there is a consensus between the Contracting States that euthanasy cannot be regarded as a right and this consensus is reflected in the law of the large majority of them. “Protection of the private life” and the “personal autonomy” cannot be regarded as giving a right to choose when and how to die. The fact that the State does not interfere with committing suicide does not mean that there is a right to commit suicide. Like committing other wrongs, people are unconstrained to commit or assist suicide but this unconstraint is not to be seen as a reflection of a right. In conclusion, it is not possible to impose an obligation on the State to permit or -more heavily- to be in a wrong.

Özet

Ötanazi ile ilgili olarak vermiş olduğu kararlar incelendiğinde, Av- rupa İnsan Hakları Mahkemesi’nin ötanazi konusunda giderek esneyen bir durum sergilediği izlenimi uyanmaktadır. Hâlbuki, Mahkeme’nin, ötanazinin bir hak olarak iddia edilemeyeceği konusunda net bir tutum sergilemesi gerekir. Taraf devletlerin, ötanaziyi hukuken tanımak bakı- mından bir takdir marjından söz etmek mümkün değildir. “Sözleşme’nin amacı” ve yaşam hakkını koruyan 2 nci maddesi, bu sonuca ulaşmak için yeterli yorum vasıtalarıdır. Yine, taraf devletler arasında, ötanazinin hak olarak iddia edilemeyeceği konusunda bir konsensüs vardır ve bu durum büyük çoğunluğunun iç hukukuyla teyit edilmektedir. Özel hayatın ko- runması ve kişisel otonomi, ne zaman ve nasıl öleceğini seçme hakkı veren kavramlar değildir. Devletin, intihar etmeye müdahale etmiyor oluşu, intiharın bir hak olduğu anlamına gelmemektedir. Diğer haksız- lıkların gerçekleştirilmesi bakımından olduğu gibi, intihar edip etmemek veya intihara “yardım” edip etmemek bakımından kişiler serbesttir, an- cak bu serbestiyet, mevcut olan bir hakkın uzantısı olarak anlaşılmama- lıdır. Sonuç olarak, devlete, bir haksızlığa izin vermek veya bundan daha ağır olarak, bir haksızlığın içinde yer almak gibi bir yükümlülük yükle- mek mümkün değildir.
