Abstract
The article deals with the central provisions of the german genetic diagnosis law. The GenDG (genetic diagnosis law) was entered into force on 1st of February 2010. It extends to various areas, dealing with the genetic data and includes the genetic analysis for medical purposes, clearance of descent and the genetic analysis in the insurance sector and the working area. In Germany the genetic diagnostic law is extremely controversial. The problems concerning the conception and application of the law are discussed. These are related to the key issue, what the genetic analysis represents. In addition the concepts of a so-called big and a small genetic counselling are presented, depending on whether the genetic analysis is aimed on predictive application. The education about accidental and incidental findings and questions about the quality assurance are also addressed.

Bu makale, Alman Genetik Teşhis Kanunu’nun temel hükümleri üzerinde durmaktadır. GenDG (ya da GenTK) (Genetic Diagnosis Law – Genetik Teşhis Kanunu) 01.02.2010 tarihinde yürürlüğe girmiştir. Kanun, genetik veriler, genetik analizin tıbbi amaçlar ve soybağının belirlenmesine yönelik olarak kullanılması ile sigorta ve çalışma konularında genetik analizin önemi başta olmak üzere birçok konuya değiniyor. Almanya’da Genetik Teşhis Kanunu oldukça tartışmalıdır. Kanun’un yansıttığı görüşler ve uygulanmasına ilişkin problemler tartışma konularını oluşturmaktadır. Bu problemler, genetik analizin neler sunduğu – ki bu da direngi noktasıdır- noktasında toplanmaktadır. Bunlara ek olarak, sözde büyük ve küçük ölçekli genetik danışmanlığı kavramlarına, genetik analizin tahmine dayalı uygulamaya yönelik olup olmadığı hususuna dayalı olarak yer verilmiştir. Makalede ayrıca rastlantısal ve tesadüfi bulgularla ilgili eğitim ve nitelik güvencesi hususlarına da değinilmektedir.
