Genetic testing legislations in comparative law

Abstract

Recent developments in genetics have initiated various attempts to take stand on the protection of human rights and human dignity. In front of the new genomic era with the completion of the Human Genome Project in 2003, several questions addressing human genetic testing emerged, some looking suspiciously like legal acts.. Despite the critique on genetic exceptionalism, it is argued that in certain situations detection of a serious genetic anomaly may cause extra anxiety in a person tested, if the knowledge has a great significance also to other family members. Regulative needs should depend on the context and purpose of the test. This presentation examines the legal framework governing the use of genetic tests in the clinical setting in various countries around the world. Some countries have enacted genetic specific laws, and some have comprehensive provisions pertaining genetic testing in their biomedical legislation. Central provisions in legislations cover informed consent, autonomy and integrity of the person tested, further uses of tests results, quality requirements of the personnel and facilities involved. Moreover, contemporary challenges related to whole genome sequencing, direct-to-consumer genetic tests and insurance are briefly discussed.

Genetik alanındaki yeni gelişmeler insan hakları ve insan onurunu korumayı da beraberinde getirmiştir. 2003 de İnsan Genom Projesinin tamamlanmasından sonra insan genetik testlerine ait kuşkular özellikle de hukuksal düzenlemelere yönelik ihtiyaçlar artmıştır. Genetik testlere yönelik bu testlerin diğer testlerden ne gibi farklı olduklarının yanında ciddi bir genetik anomali saptanması ile kişilerde ve ilgili aile bireyle- rinde olabilecek endişeler, bu bilginin test edilen kişi dışında da etkili olabilme özelliği, ayrımcılıkta, sigorta, işe alınmalarda kullanılma so- runları tartışılmıştır. Bu çalışmada esas olarak genetik teşhislere ait uluslararası hukuksal düzenlemelere yer verilmiştir. Bazı ülkelerde ge- netik testlere ait özel kanunlar olup bazılarında genel kanunlar içinde düzenlemeler yapılmakta, bazı ülkelerde hiç düzenleme bulunmamakta- dır. Bu bildiride hukuki çerçevede ortak olarak aydınlatılmış onam, testlerin ileri kullanımı, test merkezlerinde yer alan kişi ve merkez yapı- sının kalite standartlarının belirlenmesi, kişilerin otonomisi, test edilen kişilerin kişilik hakları değerlendirilmiştir.
