THE EFFECT OF ERROR MARGIN IN GENE EXAMINATIONS ON DENIAL OF PATTERNITY ACTION

Abstract
The way of establishing the paternity relationship in terms of Turkish Law is regulated through Turkish Civil Code in Article 282 in a restrictive manner. According to this provision, the paternity relationship between the child and the mother shall be established by the birth, and the paternity relationship between the father and the child shall be established by the marriage with the mother, or recognition or before the court by the provision of paternity to be given in the lawsuit. The judge will investigate the paternity relationship between the child and the father. Gene examinations are usually applied to determine the genetic genealogy of the child. The Court of Appeal does not accept a less than 99.73% possibility, which it considers as a threshold limit on the gene examination conducted by the local court. It is important to ensure that all stages from the acquisition of the DNA profile to the report examination are carried out by the method and by experts. Being more careful is compulsory to avoid any human error or laboratory conditions. The institutions and organizations that give opinions on such an important issue must be required to be certified according to the EUROLAB rules adopted by the European Union.

Türk Hukuku bakımından soybağı ilişkisinin ne şekilde kurulacağı, Türk Medeni Kanunu'nun 282. maddesinde sınırlayıcı şekilde düzenlenmiştir. Bu hüküm uyarınca, çocuk ile ana arasındaki soybağı doğumla, baba ile çocuk arasındaki soybağı ise ana ile evlilik, tanıma veya açılan davada verilecek babalık hükmü ile kurulur. Hakim, çocuk ile baba arasındaki soybağını araştıracaktır. Çocuğun genetik soybağının belirlenmesinde, genellikle gen incelemelerine başvurulmaktadır. Yargıtay, yerel mahkeme tarafından yaptırılan gen incelemesinde eşik sınır olarak kabul ettiği % 99.73’den daha az olasılıklı bir sonucu kabul etmemektedir. DNA profilinin elde edilmesinden, inceleme sonucunda düzenlenen rapora dek, tüm aşamaların yöntemince ve uzman kişiler tarafından yürütüldüğünden emin olmak gerekir. Yapılacak bir insan hatası ya da laboratuar koşullarındaki olumsuzluktan sakınmak için gerekli özenin gösterilmesi zorunludur. Böylesine önemli bir konuyla ilgili görüş bildiren kurum ve kuruluşların, Avrupa Birliği tarafından benimsenen EUROLAB kurallarına göre sertifikalandırılmasının zorunlu olması gerekir.
