A REMARK ON THE PROVISIONS (BGB §§ 630A-H)OF THE GERMAN CIVIL CODE ABOUT THE TREATMENT CONTRACT

Abstract

Medical law is experiencing a very rapid development. Like every legislator, the German legislator has also considered this development. In this sense, after the long discussion, German legislator introduced the treatment contract as an independent contract type - in the light of the established jurisprudence - into the German Civil Code (BGB). It can be asked what significance this regulation has for Turkish medical law and the law of obligations. It is already known that Turkish medical law is influenced by German medical law. In other words, the development of Turkish medical law literature is largely influenced by German medical law. It can be said, therefore, that the explanation of these changes is useful and even necessary from the point of view of Turkish law. In order to correctly assess the position of Turkish medical law, the new provisions of the German Civil Code on treatment contracts were analysed and the general framework of the Act was summarised.

Özet

Tıp hukuku çok hızlı bir değişim yaşamaktadır. Her kanun koyucu gibi Alman kanun koyucusu da bu değişimi dikkate almıştır. Bu anlamda Alman kanun koyucusu uzun bir tartışma evresinden sonra tedavi sözleşmesini bağımsız bir sözleşme tipi olarak yerleşik içtihatlar ışığında BGB’ye eklemiştir. Bu değişikliğin Türk tıp ve borçlar hukuku için ne tür bir önemi olduğu sorulabilir. Bilindiği üzere Türk tıp hukuku Alman tıp hukukunun etkisi altındadır. Diğer bir deyişle Türk hukuk doktrini gelişimini büyük ölçüde Alman tıp hukukunun etkisi altında sürdürmektedir. Bu yüzden Türk hukuku bakımından bu değişliklerin açıklanmasının faydalı hatta gerekli olduğu söylenebilir. Türk tıp hukukunun durumunu doğru değerlendirebilmek için, bu değişiklikler analiz edilmiş ve yasanın genel çerçevesi özetlenmiştir.
