Abstract

Reproductive rights are absolute constitutional rights that can only be exercised personally and that do not provide the authority to claim. The boundaries should be drawn in relation to the principle of the protection of the family without violating the essence of these rights. The ban on heterologous insemination should be only possible by a provision of law. Although our legislation does provide regulatory provisions that ban the donation of reproductive cells; this situation is constitutionally in conflict with the rule which states that rights and liberties can only be limited by law. Also, in Criminal Code, there is not a provision which specifically sanctions heterologous insemination.

Özet

Üreme hakkı, talep yetkisi içermeyen, kişiye sıkı sıkıya bağlı mutlak bir anayasal haktır, sınırları Anayasa ile korunan ailenin korun- ması ilkesi kapsamında özüne dokunmadan çizilmelidir. Heterolog döl- lenmenin yasaklanması ancak bir Kanun hükmü ile mümkün olmalıdır. Mevzuatımızda üreme hücrelerinin bağışını engelleyen yönetmelik hü- kümleri bulunmakla beraber, bu durum Anayasal açıdan temel hak ve özgürlüklerin kanunla sınırlanacağı kuralına aykırıdır. Ceza Kanunu’nda da sırf heterolog döllenme nedeniyle öngörülmüş bir yaptırım da bulun- mamaktadır.
