ANALAYSIS OF PHYSICIAN’S LIABILITY OWING TO ACTING WITHOUT AUTHORITY

Abstract

Physicians are obligated to perform their task carefully. Otherwi- se, the responsibility of the physician will arise. This liability may arise from legal, criminal and administrative. The contractual relationship forms the basis of the legal responsibility of the physician. This respon- sibility may be a contractual liability or a liability arising from pre- contract negotiations which is culpa in contrahendo. There are various opinions in the doctrine about which contract the legal nature of the relationship between the physician and the patient is based on. In gene- ral, the underlying contract varies according to the nature of the medi- cal intervention. In some cases where physician give medical interven- tion, there is no valid contract between the physician and the patient. In these cases, physician liability based on acting without authority. This study will examine the kinds of acting without authority that can be per- formed by the physician and the responsibility that arises from acting without authority.

Hekim, mesleğini icra ederken gerekli özeni göstermekle yüküm-lüdür. Aksi halde hekimin sorumluluğu doğacaktır. Bu sorumluluk te-melde hukuki, cezai ve idari şekilde karşımıza çıkmaktadır. Hekiminhukuki sorumluluğunun temelini sözleşme ilişkisi oluşturmaktadır. Busorumluluk sözleşme kaynaklı sorumluluk olabileceği gibi sözleşmeöncesi görüşmelerden kaynaklı sorumluluk da olabilmektedir. Hekim ilehasta arasındaki ilişkinin hukuki niteliğine dair doktrinde çeşitli görüşlermevcuttur. Genel olarak tıbbi müdahalenin niteliğine göre dayanak söz-leşme değişmektedir. Hekimin tıbbi müdahalede bulunduğu bazı durum-larda ise hekim ile hasta arasında geçerli bir sözleşme yoktur. 1 Bu hal-lerde hekimin sorumluluğu vekaletsiz iş görmeye dayanmaktadır. Buçalışmada hekim tarafından gerçekleştirilebilecek vekaletsiz iş görmeçeşitleri ve hekimin vekaletsiz iş görmeden kaynaklanan sorumluluğuincelenecektir.
