EXPERT WITNESS SYSTEM IN TURKEY AND SLOVAKIA BASED ON EXAMPLE OF FORENSIC MEDICINE

Abstract
Slovakia, which has regulated the legal system after agnegating of Czechia, within the harmonization framework of the European Union; The legal system of the Slovak can be a role model in order to protect the update of the legal system of our country and to adapt to the new developments. The reason is; Slovak legal system is modern, regulated by taking care of the EU's current legislation, new members of the continental european legal system. Medical science has evolved with many innovations in our day. As a science, regulations must keep up with the developments of medical science. Likewise, the development of expertise should keep pace with the development of technology, as different expertise areas are emerging and the boundaries between existing areas are inadequate, which can be used as evidence in cases, solutions requiring special and technical knowledge. For this reason, in our study, expert witness systems in Turkey and in Slovakia are compared on the basis of forensic medicine. The structure of the forensic medicine institution in Slovakia is similar to that of Turkey except for the authorities granted to persons and institutions. Furthermore, cases where the autopsy is mandatory in Slovak Law are legally counted. Outside of these cases, the court has been granted the discretion of autopsy on law enforcement authorities, prosecutors and courts. Systematic differences like this have been evaluated in terms of Turkish Law, taking into account the reasons.
Özet
Çekya'dan ayrıldıktan sonra hukuk sistemini, Avrupa Birliği'ne uyum çerçevesinde yeniden düzenleyen Slovakya; hukuk sistemlerinin, yeni olması, AB'nin güncel mevzuatlarının gözetilerek düzenlenmesi, kıta avrupası hukuk sisteminin yeni üyelerinden olması ve güncel sorunların da değerlendirilerek hazırlanması sebebiyle, ülkemiz hukuk sisteminin güncelliğini koruması ve gelişen yeni olgulara uyum sağlaması yolunda Slovak hukuk sistemi rol model olabilecek konumdadır. Tıp bilimi çağımızda birçok yenilikle beraber kendini katlayarak gelişmiştir. Bir bilim olarak hukukun, tıp bilimi ile ortak alanlarının da bu gelişime ayak uydurması gerekmektedir. Yine, teknolojinin gelişimi ile davalarda delil olarak kullanılabilecek, çözümü özel ve teknik bilgiyi gerektiren konularda, farklı uzmanlık alanları ortaya çıkması ve mevcut alanlar arasındaki sınırların yetersiz kalması sebebiyle bilirkişilik kurumu da aynı gelişime ayak uydurmalıdır. Bu sebeplerle çalışmamızda, adli tıp uygulamaları temelinde Türkiye'de ve Slovakya'da bilirkişilik kurumları karşılaştırılmıştır. Slovakya'da adli tıp kurumunun yapısı kişilere ve kurumlara verilen yetkiler dışında Türkiye ile benzerdir. Ayrıca, Slovak Hukukunda otopsinin zorunlu olduğu haller kanuni olarak sayılmıştır. Bunların dışındaki durumlarda kolluk yetkililerine, savcı ve mahkemeye otopsi yaptırılması hakkında takdir yetkisi tanınmıştır. Bunun gibi sistemsel farklılıklar, sebepleri de gözetilerek Türk Hukuku açısından değerlendirilmiştir.
