Abstract

The right to health is regulated as a social right in national and international law documents. However, as a result of being related to other human rights, the right to health has both personal and social rights aspects. This aspect of the right to health has diversified the obligations of states and clarification of the responsibilities of the states are being required accordingly. Moreover, in recent years, as a result of the widespread practice of privatization in the field of health industry, the issue of the state's obligations to protect the right to health of individuals from the actions of private individuals has gained more importance. For the above-mentioned reasons, it is important to draw the limits of the state's responsibility arising from the right to health in both domestic and supranational human rights law. Although the right to health is regulated in most of the human rights documents at the United Nations, it is mainly protected by the 25th article of the Universal Declaration of Human Rights (UDHR). The most comprehensive regulation defines the obligations of the states within the scope of the right to health is the Article 12 of the UN’s International Economic, Social and Cultural Rights Convention. In addition, the General Comment No. 14 of the Committee on Economic, Social and Cultural Rights could be used as a guide in determining the scope of the Article 12. Consequently, our study examining the states’ responsibility on protecting the right to health is mainly based on these international law documents

Özet

Sağlık hakkı ulusal ve uluslararası hukuk belgelerinde sosyal haklar arasında düzenlenmektedir. Fakat sağlık hakkının diğer insan haklarıyla bağlantılı olması sonucu hem kişisel hem de sosyal haklara bakanyönleri bulunmaktadır. Nitekim sağlık hakkının bu özelliği devletlerinbu hakkı sağlamaya yönelik yükümlülüklerini çeşitlendirmiş ve sorumluluğunun belirginleştirilmesini gerektirmiştir. Öte yandan son yıllardasağlık alanında özelleştirme uygulamalarının yaygınlaşması sonucu,devletin kişilerin sağlık hakkını özel kişilerin eylemlerinden korumayükümlülüğü konusu önem kazanmıştır. Bu sebeple hem iç hukukumuzda hem de ulusalüstü insan hakları hukuku doktrininde devletin sağlıkhakkından doğan sorumluluğunun sınırlarını çizmek önem arzetmektedir.Birleşmiş Milletler (BM) düzleminde insan hakları belgelerininbirçoğunda sağlık hakkı korunsa da temel olarak İnsan Hakları EvrenselBeyannamesi’nin (İHEB) 25. maddesinde koruma alanı bulmuştur. Sağlık hakkı kapsamında devletin yükümlülüklerine işaret eden en kapsamlıdüzenleme ise BM’nin Ekonomik, Sosyal ve Kültürel Haklar Uluslarara-sı Sözleşmesi’nin (ESKHS) 12. maddesinde yer almaktadır. Ayrıca 12.maddenin içeriğinin belirlenmesinde Ekonomik, Sosyal ve Kültürel Haklar Komitesi’nin (ESKHK) 14 Sayılı Genel Yorumu rehber nitelik taşımaktadır. Dolayısıyla çalışmamızda sağlık hakkının korunmasında devletin sorumluluğu esasen bu uluslararası hukuki belgeler temelinde elealınmıştır.
