Abstract

Tele-medicine means providing health services using new technology and modern medical devices. Tele-medicine covers a wide range of health services such as remote consultation, remote examination, treatment and prescription. First of all, in order to provide tele-medicine services to patients, it requires informed consent about how the services will be provided, the treatment method and the possible risks of this method. Tele-medicine service providers are sometimes physicians and sometimes medical centers. When these services are provided by the physician, the contract is bilateral between the physician and the patient, and imposes both contractual and legal liability on the physician. On the other hand, when services such as remote surgery are offered to the patient, the treatment center where the surgery takes place is a party to the patient's contract. In addition, the physician has a responsibility on this respect.

Özet

Tele-tıp, yeni teknoloji ve modern tıbbi cihazlar kullanılarak sağlık hizmetleri sunulması anlamına gelmektedir. Tele-tıp, uzaktan danışma, uzaktan muayene, tedavi, reçete gibi çok çeşitli sağlık hizmetlerini kapsamaktadır. Öncelikle hastalara tele-tıp hizmetlerinin sağlanması için, hizmetlerin nasıl sağlanacağı, tedavi yöntemi ve bu yöntemin olası riskleri konusunda aydınlatılmış rızaları gerektirmektedir. Tele-tıp hizmet sağlayıcıları bazen hekim, bazen de tıp merkezleridir. Bu hizmetler hekim tarafından sağlandığında, sözleşme hekim ve hasta arasında olmak üzere iki taraflıdır ve hekime hem sözleşmeden doğan sorumluluk hem de kanunlardan doğan sorumluluk yüklemektedir. Buna karşın hastaya uzaktan ameliyat gibi hizmetler sunulduğunda ameliyatın gerçekleştiği tedavi merkezi hastanın sözleşmesine taraftır. Ayrıca burada hekimin de sorumluluğu bulunmaktadır.
