Legal Status of Agriculture Workers in Scope of the New Labour Code No.4857

Abstract
Providing legal guarantee to all sections of a society without making discrimination is an compulsory requirement of the Principle of Social Law State. Even though agriculture workers in our country have been working under adverse working conditions they have not been given legal guarantee for many years. The new Labour Code and the Regulations issued concerning it placed agriculture workers in scope the Labour Code No. 4857 even though there are some limitations. Providing legal guarantee to agriculture workers should be accepted as an important step in this field even though this guarantee is currently limited.
Özet
Toplumda, çalısan tüm kesimlerin hukuki güvenceye kavusturulması Sosyal Hukuk Devleti Ilkesi'nin zorunlu bir geregidir. Ülkemizde, tarım kesiminde faaliyet gösteren tarım isçileri, uzun yıllar Is Kanunu'nun isçilere saglamıs oldugu hukuki güvenceden yoksun bırakılmıstır. Tarımisçileri, 4857 sayılıYeni Is Kanunu ve bu Kanuna baglı olarak çıkarılan Yönetmelikle, bazı sınırlamalarla Is Kanunu kapsamına alınmıstır. Sınırlıda olsa, tarım isçilerinin hukuki bir güvenceye kavusturulmasını, bu alanda atılan önemli bir adım olarak kabul etmek gerekir.
